Seeking 'sexual favour' is corruption under proposed law

New Delhi, Aug 21: Seeking "sexual favour" can be considered as bribe and people can be penalised for it under a new law proposed by a Parliamentary Committee.

In its report on new anti-corruption bill, the Select Committee of Rajya Sabha has endorsed Law Commission's report and recommended inclusion of "undue advantage" in a relevant provision of the proposed legislation to cover "any gratification other than legal remuneration", including sexual favours, to explain offence relating to public servant being bribed.

In a first, the Parliamentary Committee has recommended criminalising private sector bribery by bringing in corporates and their executives in the ambit of proposed anti-corruption law and recommended jail term of upto seven years along with fine.

Besides, it has suggested punishment for bribe givers too.

The instances of graft are covered under Prevention of Corruption Act, 1988. To enlarge the definition of taking bribe and cover private sector bribery, the government has decided to introduce Prevention of Corruption (Amendment) Bill, 2013, which is pending. The term used in the bill to define bribery related offences was "financial or other advantage".

In November last year, some official amendments were moved to replace the term "financial or other advantage" with "undue advantage" to make "any gratification other than legal remuneration" punishable.

The Select Committee of the Upper House examined the bill and submitted its report recently.

"Members of the Committee also felt that the purport of the words 'undue advantage' used in the proposed amendments includes all forms of pecuniary and non-pecuniary gratifications and appears to be wide enough to be misused by the enforcement agencies," the report said.

The Committee, apprehends that the enforcement or probe agencies may misuse the expression to harass public servant as well as members of civil society in corruption cases and advises that adequate precautions be taken in this regard, it said.

"The Committee, however, notes that the Law Commission of India in it Two Hundred Fifty-fourth Report (February, 2015) has suggested to use the expressions 'undue advantage' in the PC Act. The Committee endorses the aforesaid amendments proposed to Section 2 of the PC Act, 1988 under the clause," it reads.

The Law Commission had in its report said "financial or other advantage" as mentioned formulation was narrower than the proposed changes to cover "any gratification whatever, other than legal remuneration".

"For example, it clearly covers sexual favours as 'gratification' in return for the public servant to do/refrain from doing a certain act. However, "other advantage" in "financial or other advantage" being interpreted using ejusdem generis (of or as the same kind) does not seem to cover sexual favours in return for the public servant's acts or omissions.

"Thus, the proposed amendment is actually narrowing the scope of corruption, instead of the stated intent of expanding it," it said, recommending use of "undue advantage" in the proposed bill.

The report said some stakeholders were of the view that there is need to provide an explanation to the terms 'non-pecuniary benefit' (being considered as an offence under corruption) as there is every possibility of filing of malicious and false complaints against public servants.

"Further, it was also suggested that casual exchange of hospitality like presenting traditional gift, souvenir or memento subject to a certain monetary limit and courtesy lunch, dinner during meeting or official visit may not be brought under the purview of 'undue advantage'," the Select Committee report said.

The panel apprehended that the probe agencies may misuse the proposed clause to harass public servant as well as members of civil society in corruption 'and advised that adequate precautions be taken in this regard.

Bengaluru: Karnataka Home Minister G Parameshwara on Sunday said that the Special Investigation Team (SIT), probing into sexual abuse charges against Hassan MP Prajwal Revanna, will not be going abroad to bring him back, and the Interpol will share information about him.

He also cautioned political leaders about making public statements or sharing information in connection with the case, which is sensitive.

The 33-year-old Prajwal Revanna, who is grandson of JD(S) patriarch and former Prime Minister H D Deve Gowda, is facing charges of sexually abusing several women.

The scandal has raised a political storm with the ruling Congress and BJP-JD(S) engaged in a slugfest.

Prajwal Revanna is said to have flown abroad on April 27, a day after the first phase of Lok Sabha polls in Karnataka was held.

He was BJP-JD(S) alliance's joint candidate from Hassan Lok Sabha segment, which went to polls in the first phase.

"No, there is no such option. Blue Corner Notice has been issued and the Interpol will share the information. The respective country in which he is found or identified - they will inform them (Interpol) and then our agencies, the CBI will get to know, and through them we will get to know."

"So far there is no information," Parameshwara said.

He was responding to a question on reports about the SIT team travelling abroad in connection with the case.

Speaking to reporters, he said, "Investigation is going on, not to affect the investigation we don't want to share any information."

Responding to a question on Union Minister Pralhad Joshi's statement alleging conspiracy behind the arrest of BJP leader Devaraje Gowda, for making allegations against Congress leaders in connection with the case, Parameshwara said, "If anyone says anything I cannot react to it. We cannot respond to every public statement. As this is a serious case, we cannot share information until the investigation is completed."

"My request to the public and to our leaders is to be cautious while making statements. If not, based on the statements given by them, we may have to call them for investigation and record their statement under 41 A of CrPC," he added.

Asked whether JD(S) leader H D Kumaraswamy will also be served notice, the Minister said he is a former CM and that he believes that the former has taken this case seriously.

"Before giving any statements on this case or before sharing any information in the public domain, one has to be cautious, and this applies to all," he added.

Madikeri, May 11: Kodagu police have apprehended the man allegedly responsible for the brutal murder of a minor girl within the confines of Kumbaragadige village in Karnataka's Somwarpet taluk. 

Kodagu Superintendent of Police, K Ramarajan, disclosed that the arrested individual is Prakash (32) from Hammiyala village in Somwarpet taluk. However, authorities are still in the process of recovering the severed head of the victim. The perpetrator had absconded with the victim's severed head after committing the crime. 

Search operations for the suspect commenced late on Thursday night (May 9), with officials diligently pursuing leads. Acting on information suggesting the suspect's presence in a forested area near the village, the police swiftly moved in and apprehended him.

The victim US Meena, 15, a student of Surlabbi High School, had passed the SSLC examinations, the results of which were announced on May. One same day, she was murdered. 

Reportedly, the engagement of the minor girl with the suspect was thwarted by officials from the Women and Child Development department. Subsequently, officials persuaded the girl's parents against proceeding with the marriage. 

However, despite these interventions, the suspect forcibly entered her residence during the night, purportedly abducted her, and later perpetrated the heinous crime in a wooded area on the outskirts of the forest, before absconding with her severed head.

New Delhi: Congress leader Rahul Gandhi has written to Karnataka Chief Minister Siddaramaiah, urging him to extend all possible help to the victims of JD(S) leader Prajwal Revanna's alleged sexual abuse.

In a letter to Siddaramaiah, Gandhi condemned the actions of Revanna, an MP from Hassan in Karnataka, and accused him of enjoying immunity with the blessings of Prime Minister Narendra Modi and Union Home Minister Amit Shah.

In a veiled attack on Modi, the Congress leader said he has never come across a senior public representative who has constantly chosen silence in the face of untold violence against women.

"I request you to kindly extend all possible support to the victims," Gandhi said in his letter to the Karnataka chief minister.

"They deserve our compassion and solidarity as they fight their battle for justice. We have a collective duty to ensure that all parties responsible for these heinous crimes are brought to book," he added.

Describing the incidents as "horrific sexual violence" unleashed by the incumbent Member of Parliament, Gandhi alleged that Revanna sexually assaulted and filmed hundreds of women over several years.

"Many who looked up to him as a brother and son were brutalised in the most violent manner and robbed of their dignity. The rape of our mothers and sisters warrants the strictest possible punishment."

"I am deeply shocked to learn that as far back as December 2023, our Home Minister Shri Amit Shah was informed by Shri G Devaraje Gowda about Prajwal Revanna's antecedents, especially his history of sexual violence and the presence of videos filmed by the perpetrator," the former Congress chief said.

He said what is even more shocking is that despite these gruesome allegations being brought to the notice of the seniormost leadership of the ruling Bharatiya Janata Party (BJP) at the Centre, Modi campaigned and canvassed for a "mass rapist".

"Furthermore, the Union government wilfully allowed him to flee India to derail any meaningful investigation. The deeply perverse nature of these crimes and the absolute immunity enjoyed by Prajwal Revanna with the blessings of the Prime Minister and Home Minister deserves the strongest condemnation," Gandhi said.

"In my two decades in public life, I have never come across a senior public representative who has constantly chosen silence in the face of untold violence against women. From our wrestlers in Haryana to our sisters in Manipur, Indian women are bearing the brunt of the Prime Minister's tacit support for such criminals," he alleged.

In this backdrop, Gandhi said the Congress has a moral duty to fight for justice for "our mothers and sisters".

"I understand that the Karnataka government has constituted a Special Investigation Team (SIT) to investigate the grave allegations, and a request has been made to the Prime Minister to cancel Prajwal Revanna's diplomatic passport and get him extradited to India at the earliest," he said.

H D Revanna, the Janata Dal (Secular) MLA from Holenarasipura in Karnataka's Hassan district, is the son of former prime minister and JD(S) patriarch H D Deve Gowda and elder brother of former chief minister H D Kumaraswamy. He is facing allegations of sexually abusing women.
