2.81 crore cases pending in district courts across India

New Delhi, Jan 15: In an alarming scenario, a whopping 2.8 crore cases are pending in district courts across the country which are short of nearly 5,000 judicial officers. The situation has led to suggestions in two Supreme Court reports to increase the judicial manpower "manifold" -- at least seven times -- to overcome the crisis by appointing about 15,000 more judges in the coming few years.

The suggestions and some sharp remarks came out in two reports issued by the Supreme Court -- 'Indian Judiciary Annual Report 2015-2016' and 'Subordinate Courts of India: A Report on Access to Justice 2016'-- which also highlighted that nearly 15,000 more judges would be required in next three year to overcome this critical situation. Data showed that district courts across the country are grappling with a backlog of 2,81,25,066 civil and criminal cases in the period between July 1, 2015 to June 30, 2016. But a large number of matters, 1,89,04,222, were also disposed off during the period.

One of the key reasons for the huge figure of pending litigation is the shortage of judges in subordinate courts which is "a cause of concern", as there are 4,954 judges' posts vacant when the sanctioned strength of judicial officers was 21,324, the report on subordinate courts said. "Based on the study and keeping in mind the future growth in institution of cases, it is found that the present judge strength is insufficient to deal with a huge figure of pendency of cases, which is a cause of concern.

"Additional judicial manpower and support staff, as well as infrastructure is required immediately to handle the situation," the report said. In the backdrop of the tussle between the judiciary and the executive over appointments of judges and infrastructure, the report came out with sharp remarks over the failure of the government in dealing with these issues.

"The immediate requirement itself shows that enough has not been done to increase the judges strength of the subordinate judiciary. The State is obliged to carry out the decisions of the Apex Court and increase the Judge-Population Ratio to 50 per million as held in the All India Judges Association case. "The present judge strength is sufficient just to handle the fresh cases filed each year which ensures constancy of pendency figures. It is necessary to understand and predict that case filing patterns would change in future and device methods to keep pendency in manageable limits," it said.

The report on the subordinate judiciary also referred to the recent data of National Crime Records Bureau (NCRB) which showed that with the present strength of judicial officers in district courts, trial in only approximately 13 per cent cases was completed under the IPC during a year. "This clearly shows that the existing strength of judicial officers needs to be enhanced at least seven times so that trial is completed within a period of one year," the report said, adding that the "judicial manpower needs to be augmented manifold to cater to the situation".

The figures complied in the annual report till June 30 last year show that the district courts in Gujarat, Bihar and Uttar Pradesh were the worst affected as they were short of 794, 792 and 624 judges respectively. While the sanctioned strength of judges in lower courts in Gujarat, Bihar and Uttar Pradesh is 1953, 1825 and 2394 respectively, the number of working judicial officers are only 1159, 1033 and 1770 respectively.

The difference is also huge in Delhi where the total sanctioned strength is 793 while there were only 486 working judges, with 307 positions being vacant. The data on vacancy of judges shows that trial courts in Northeastern states of Sikkim, Manipur, Tripura and Meghalaya, were the only ones where the vacant positions were the least, with 4, 11, 29 and 16 vacancies respectively.

Expressing concern over the figures of pending cases, the report compiled on subordinate judiciary said that in the next three years, an additional 14,597 judicial officers and sanctioned judge strength of 35,155 are required in the trial courts to cater to the problem.

According to the annual report, district courts in Uttar Pradesh peaked in the pendency of cases at 58.8 lakh, including 43.73 lakh criminal cases. However, these courts also disposed of the maximum number of cases at 34.83 lakh. Maharashtra had the second highest tally of pending cases across states with a backlog of 31.8 lakh matters, which include 20.39 lakh criminal and 11.4 lakh civil, followed by West Bengal at 26.95 lakh, Bihar at 20.88 lakh and Gujarat at 20.56 lakh undecided ones. The pendency in Delhi stood at 5.98 lakh, comprising 4.32 lakh criminal and 1.65 lakh civil matters. The courts in the capital, however, disposed of 6.45 lakh cases by June 2016.

Besides Delhi, seven states were found with higher disposal rate, with Tripura and Himachal Pradesh deciding over 58 per cent of the cases. Other five states which disposed of over 51 per cent cases are Himachal Pradesh, Punjab, Haryana, Tamil Nadu and Assam. Highlighting the importance of judiciary and timely delivery of justice, the report said "justice is one critical component of citizenship which cannot be neglected.

"Overworked judges, overburdened court staff, chronic shortage of court-space and unending wait to justice does not complement the policies of the State." "The role of a robust judiciary in a nation's development is pivotal. With development and a corresponding growth in litigation, more judges will certainly be required to handle the same so that justice is done in its truest possible sense," it said.

2.8 crores cases are pending in district courts across the country... wow ...Tareek Pe Tareek, Tareek pe Tareek is given until the victim is dead,, hence the case is adjourned , and the culprits are free and back in the society to create a disturbance.

Rusted Judiciary should now transform into Robust Judiciary.

It is not the case of shortage of judges....it is the style of working ..... summer vacation......winter vacation .....monsoon vacation .... acting at the wishes of vakils , sitting and postponing the case for the next date for the whole day.... Their duty is to come and announce the next date ..... and retire for the day ....

In a fresh claim, arrested BJP leader and advocate G Devaraje Gowda has alleged that Deputy Chief Minister D K Shivakumar and four other ministers were behind exposing Prajwal Revanna’s sex scam that has brought disgrace to Janata Dal (Secular) H D Deve Gowda family. 

Devaraje Gowda has been arrested in a sexual abuse case. 

Speaking to reporters while being taken to the district prisons, in Hassan on Friday, Gowda alleged that he was offered Rs 100 crore to drag the name of H D Kumaraswamy in the Prajwal’s case. 

“D K Shivakumar had offered me Rs 100 crore to project that H D Kumaraswamy was behind the case. The offer was made through ministers N Chaluvarayaswamy, Krishna Byre Gowda, Priyank Kharge and another minister. They had even sent Rs 5 crore as advance to Bowring Club. But I did not agree. Hence, they hatched a plot to trap me,” Gowda alleged.

“It is D K Shivakumar, who collected all information from Prajwal Revanna’s former car driver Karthik and readied the pen drive. A team of four ministers were formed to handle the issue. As I did not agree to the plan. They planned to bring disrepute to the BJP, Narendra Modi and H D Kumaraswamy,” he said.

Gowda further alleged that former MLC M A Gopalaswamy of Channarayapatna was sent to him for negotiation.

“The main intention of D K Shivakumar is to bring disrepute to Modi and BJP in the case. Besides, he wanted to defame H D Kumaraswamy’s leadership in the state” he claimed. “They filed a sexual harassment and rape case against me, but found no evidence. Now, they are trying to fix me in the pen drive case” he alleged.

Bengaluru: JD(S) leader H D Kumaraswamy has claimed that 25,000 pen drives with videos of women being sexually abused allegedly by his nephew, Lok Sabha election candidate Prajwal Revanna, were distributed before polls, and accused Chief Minister Siddaramaiah and his deputy D K Shivakumar of a conspiracy.

The former chief minister also sought to discredit the Special Investigation Team (SIT) formed by the Congress government on April 28 to probe the charges against Prajwal of sexually abusing several women after videos allegedly involving him started making the rounds on social media.

"It is not a Special Investigation Team but 'Siddaramaiah Investigation Team' and 'Shivakumar Investigation Team'," the JD(S) second-in-command, who is the son of party supremo and former prime minister H D Deve Gowda, said.

MLA H D Revanna and his son and Hassan MP Prajwal have been booked for allegedly molesting their cook. In another case, Revanna has been booked and arrested for allegedly kidnapping a woman who was allegedly sexually assaulted by Prajwal. A case of rape has also been registered against Prajwal.

Addressing a press conference here, Kumaraswamy said the pen drives were circulated by police officers who were "threatened to do it".

“It (pen drive carrying videos) was released in Bengaluru Rural constituency (where the Congress candidate in the Lok Sabha elections is D K Suresh, who is the brother of Shivakumar). This was an April 21 development. On April 22, Poornachandra, our polling agent, gave a complaint to the District Deputy Commissioner, who is the Returning Officer,” the JD(S) leader said.

“Poornachandra received a message at 8 pm on April 21 asking people to 'follow a WhatsApp channel to see Prajwal Revanna’s sleaze video'. There was a message on this WhatsApp channel, 'Countdown for the release of Prajwal’s sleaze videos'," Kumaraswamy further said.

According to Kumaraswamy, one Naveen Gowda had sent the message about the "countdown".

In his complaint to the Deputy Commissioner and the Superintendent of Police of Hassan district, Poornachandra has named five people including Naveen Gowda, Karthik Gowda (Revanna’s driver), Chethan and Puttaraju alias Putty, he said.

It has been more than a fortnight since the complaint made on April 21 but no action has been taken against these five people, Kumaraswamy said and demanded that they should first be arrested for "mortgaging the modesty" of women in the videos.

Kumaraswamy alleged that 25,000 pen drives were distributed in the entire state, and cited a report in a regional daily to support his claim.

“My question here is why no action was taken. If someone posts something on social media, immediately houses are searched and the person is made to sit in the police station. Why no action was taken against these five people despite a complaint?” he asked.

"Chief Minister Siddaramaiah had confidently said that all the three JD(S) candidates in the Lok Sabha elections will be defeated," Kumaraswamy said, adding, "It raises doubts about the involvement of many people."

On April 25, Karnataka State Commission for Women Chairperson Nagalakshmi Chowdhary wrote to Siddaramaiah demanding an SIT probe into the tapes where Prajwal is allegedly seen sexually abusing several women. The same night, the CM gave his nod and ordered the formation of a SIT, Kumaraswamy said.

“In that letter, Nagalakshmi Chowdhary did not mention the name of Prajwal or Revanna but the chief minister called it ‘Prajwal Revanna’s explicit videos’ in his post on X when he announced the formation of SIT. This shows how the conspiracy was hatched,” the JD(S) leader claimed.

He also alleged that the first complaint "framing" his brother H D Revanna and nephew Prajwal was typed on a computer in Bengaluru and was sent to Holenarasipura, which is represented in the Karnataka Legislative Assembly by Revanna, on April 28.

“It’s not a Special Investigation Team but there are two teams within it – one is ‘Siddaramaiah Investigation Team’ and another one is ‘Shivakumar Investigation Team’,” he charged.

He said the ‘convenor’ of the 'pen drive story', Karthik Gowda should be traced first and brought before the people.

“Going through the conspiracies, one can doubt the intention behind the investigation because more than protecting the women victims, you are limiting the scope of the probe only to defame people,” Kumaraswamy further alleged.

He underlined that he was not trying to protect anyone. “I have said that in this case I will not protect anyone doing wrong. Stringent punishment should be given to the person involved in this crime as per the law of land."

Madikeri, May 11: Kodagu police have apprehended the man allegedly responsible for the brutal murder of a minor girl within the confines of Kumbaragadige village in Karnataka's Somwarpet taluk. 

Kodagu Superintendent of Police, K Ramarajan, disclosed that the arrested individual is Prakash (32) from Hammiyala village in Somwarpet taluk. However, authorities are still in the process of recovering the severed head of the victim. The perpetrator had absconded with the victim's severed head after committing the crime. 

Search operations for the suspect commenced late on Thursday night (May 9), with officials diligently pursuing leads. Acting on information suggesting the suspect's presence in a forested area near the village, the police swiftly moved in and apprehended him.

The victim US Meena, 15, a student of Surlabbi High School, had passed the SSLC examinations, the results of which were announced on May. One same day, she was murdered. 

Reportedly, the engagement of the minor girl with the suspect was thwarted by officials from the Women and Child Development department. Subsequently, officials persuaded the girl's parents against proceeding with the marriage. 

However, despite these interventions, the suspect forcibly entered her residence during the night, purportedly abducted her, and later perpetrated the heinous crime in a wooded area on the outskirts of the forest, before absconding with her severed head.
