Encroachment of Wakf land in Mangaluru: BJP leader’s multi-crore complex raises eyebrows

Amidst uproar over encroachments of the Wakf properties across India, a huge building has illegally come up on a Wakf land worth several crores of rupees in the heart of the city of Mangaluru in coastal Karnataka. Shockingly, the local administration too has helped a politician’s family to construct the illegal building on the land belonging to the historic Kutchi Memon Masjid in the city.

In fact, the illegal construction work on the Wakf land started around three years ago and now a six-story commercial-cum-residential complex has almost reached its completion after illegally crossing several legal hurdles. Reliable sources said that a leader of Bhartiya Janata Party had managed to mislead the officials of Mangaluru Urban Development Authority (MUDA) and Mangaluru City Corporation (MCC) and obtain licence for the constriction with the help of an illegal ‘permission letter’ from a staff of the mosque.

Occupancy tenants

The 2.5 acres land belonging to the mosque and located at Golikatta Bazar in Bundar area of Mangaluru city had been declared as Wakf property in 1968 through a gazette notification. For the past few years, one Keshava Mijar and his family had been living in 69 cents of land of the same 2.5 acres as occupancy tenants (moola geni basis). Around three years ago, Keshava Mijar’s five children including Ravishankar Mijar, vice-president of Dakshina Kannada district unit of BJP, jointly started constructing a complex after demolition the small buildings on the land.

Completely illegal

Any development work or construction of building on a Wakf land without obtaining a no objection certificate (NOC) directly from the Wakf board will be considered illegal. However, a staff of the mosque, apparently violating his jurisdiction, had reportedly given a written permission using the official letterhead of the mosque to the tenants (Mijar siblings) to construct the complex. The tenants had reportedly paid him Rs 12.5 lakh for this favour. 

Even though the permission letter given by the staff of the mosque doesn’t authorise the tenants to construct the building, they went ahead with their multi-crore project. In December 2013, the MUDA provided single site approval to the tenants in violation of the rules or without verifying the documents of the land. In November 2014, the tenants received licence for the construction work from the MCC too. 

MCC serves notices

Even thought the illegal construction process started three years ago the state Wakf board recently woke up following a complaint and directed the local administration to stop the illegal construction work. After realising its blunder, the MCC served notices to Ravishankar Mijar and his siblings.

Rs 100 rent for 69 cents land!

However, the BJP leader and his siblings have claimed that the land legally belongs to them. “We, the five siblings, have obtained single site approval from the MUDA. Hence, we have all the rights to construct the building in this 69 cents land. Besides, we are still paying Rs 100 rent every month to the mosque without fail. There is no meaning in arguing that this is Wakf land,” says Ravishankar Mijar.

Legal action awaited

According to MCC Commissioner Mohammed Nazir, the civic body had granted licence for the construction of the complex based on the single site approval issued by the MUDA in 2013 to Ravishankar Mijar and siblings. “However, now we have received information that the property belongs to the Wakf. Hence we will seek the opinion from the legal advisors before taking further action,” he said.

Dakshina Kannada Deputy Commissioner Sasikanth Senthil said that he had already directed the assistant commissioner to look into the issue. “If there are sufficient documents to prove that it’s a Wakf land then the building will be considered illegal and further action will be taken,” he said. 

Dakshina Kannada Wakf Advisory Committee chief Kanachur Monu holds MCC and MUDA officials responsible for illegal construction. “A tenant cannot become the owner of the Wakf land just by bribing some people. Even if he creates some documents, they are considered illegal documents. The tenants have illegally constructed a building on land worth Rs 30 crore. It is the responsibility of the authorities concerned to clear the encroachment at the earliest and reclaim the Wakf land,” he said.

This might be the case of encroachment of BJP land by mosque. I know mijar family and they are very honest and nationalist people. They don’t want the property of Pakistani supporters. It was BJP which exposed the encroachment of Wakf property by Congress minister. But Sidramullah’s Khan grace govt is fooling muzzis.

Congress government will not take action because it knows that many of Congress bigwigs are doing the same. Paying Rs 10 monthly rent to the mosques and running giant commercial complexes and earning crores.

Mangaluru: Six youths including teenagers have been arrested by the Bantwal Rural Police in connection with a brutal assault on 21-year-old Aboobakar (name changed to hide identity), an incident that was widely shared on social media after footage revealed the victim tied to a pole and violently beaten.

The arrested individuals, all from Kanchinadkapadavu, Sajipanadu village in Ullal Taluk, have been identified as Mohammad Sapwan (25), Mohammad Rizwan (25), Irfan (27), Anis Ahmad (19), Nasir (27), and Shakeer (18). According to police reports, the assault took place on November 7 in Kanchinadkapadavu.

The sequence of events began when Aboobakar was reportedly called to a residence in Kanchinadkapadavu by a female relative. Upon his arrival, he was confronted by the accused, who questioned his presence, tied him to a pole with ropes, and attacked him while he was shirtless. 

Aboobakar managed to file a police complaint the following day, detailing the assault. As his injuries worsened, he was admitted to a private hospital in Mangaluru.

While in the hospital, Aboobakar alleged that his attackers intended to kill him during the assault. This statement led to additional charges of attempted murder being filed. 

Police officials stated that the suspects were subsequently apprehended, charged with group assault and attempted murder, and placed in judicial custody. The investigation is ongoing, and further details are awaited.

Bengaluru: In a boost to the ruling Congress in Karnataka, the party on Saturday swept the by-polls to three Assembly segments, causing a major setback to the BJP-JD(S) alliance in the state.

The Congress has retained Sandur, the seat considered to be its strong hold, and has also bagged Shiggaon and Channapatna segments, which were earlier held by BJP and JD(S) respectively.

The November 13 by-polls to Sandur, Shiggaon and Channapatna Assembly segments had witnessed a fierce fight between the ruling Congress and a combative BJP-JD(S) alliance.

The by-polls to Sandur, Shiggaon and Channapatna were necessitated as the seats fell vacant following the election of their respective representatives -- E Tukaram of Congress, former CM Basavaraj Bommai of BJP, and Union Minister Kumaraswamy of JD(S) to Lok Sabha in May elections.

The by-polls witnessed a straight fight between the ruling Congress and BJP in Sandur and Shiggaon segments, while in Channapatna, JD(S) which is part of the NDA alliance took on the grand old party.

Congress' C P Yogeeshwara won the Channapatna segment, defeating JD(S) candidate and Kumaraswamy's son Nikhil Kumaraswamy, by a margin of 25,413 votes.

Former CM Basavaraj Bommai's son Bharath Bommai of BJP faced defeat against Congress' Yasir Ahmed Khan Pathan in Shiggaon Assembly segment by a margin of 13,448 votes.

In Sandur, Congress candidate E Annapoorna, the wife of Bellary MP E Tukaram, won the seat vacated by her husband, by a margin of 9,649 votes.

Congress' win in the by-poll is seen as an endorsement of both Chief Minister Siddaramaiah and his deputy D K Shivakumar's leadership, and the government's programmes, especially the five guarantee schemes.

Nikhil Kumaraswamy and Bharath Bommai, the third generation of Gowda and Bommai family respectively, who contested this bypolls, have lost. Their fathers and grandfathers had served as Karnataka's Chief Ministers in the past.

While for Bharath Bommai this was his electoral debut, for Nikhil it was his third electoral loss.

Among the three segments, Channapatna was considered to be a high profile battle, where the contest was between C P Yogeeshwara and actor-turned-politician Nikhil Kumaraswamy.

A five-time MLA from the segment and a former Minister, Yogeeshwara had joined the Congress after quitting BJP ahead of nomination.

There were plans to field Yogeeshwara on a JD(S) ticket, but he was not interested in it, and instead wanted Kumaraswamy to support him as BJP candidate. This was not acceptable to Kumaraswamy and his party, following which Yogeeshwara jumped ship.

However, Kumaraswamy had subsequently said he had agreed to Yogeeshwara contesting from BJP, and despite that he jumped ship to Congress, under the influence of Deputy Chief Minister D K Shivakumar and his brother and former MP D K Suresh.

Nikhil had faced defeat in 2019 Lok Sabha and 2023 Assembly polls. It is seen as a setback for Kumaraswamy too, as he could not ensure son's win from the Channapatna, the seat he had twice represented in the past.

Congress' win is crucial for Shivakumar, who is also the state Congress chief and his brother Suresh to strengthen their position in their home district of Ramanagara, a Vokkaliga heartland.

In Shiggaon, BJP's Bharath Bommai, son of Basavaraj Bommai lost against Congress' Yasir Ahmed Khan Pathan, who had faced defeat against the former Chief Minister in the 2023 Assembly polls.

Initially, former MLA Syed Azeempeer Khadri, a Congress' ticket aspirant, had raised a banner of revolt in Shiggaon, by filing his nomination as an independent, but later withdrew after intervention by party leadership.

In Sandur, Bellary MP Tukaram's wife E Annapurna of Congress won from the seat vacated by her husband, against BJP ST Morcha president Bangaru Hanumanthu, who is considered close to party leader and former mining barron G Janardhan Reddy.

Sandur is a Congress' bastion, and Tukaram had represented it four times.

Congress winning the by-polls is seen as "crucial" for Chief Minister Siddaramaiah to assert himself , amid demands for his resignation following charges against him in the MUDA site allotment case.

There were also behind-the-scenes political activities within the ruling Congress earlier this year, with a few ministers in his Cabinet holding closed door meetings, fueling speculation about leadership change. But such activities came to a halt following instructions from the party high command.

It is equally important for Shivakumar, who has not shied away from openly expressing his Chief Ministerial ambitions, amid speculations over "rotational Chief Minister formula," according to which he will become CM after two-and-half years (in this govt's five years tenure), but they have not been officially confirmed by the party.

The defeat in this by-poll is seen as a setback for state BJP President Vijayendra, who has been facing intense criticism and opposition from a section within the party, who have raised a banner of revolt against his leadership accusing him and his father, veteran leader B S Yediyurappa of "adjustment politics".

Mysuru, Nov 12: Zameer Ahmad Khan, the Tourism and Waqf minister of Karnataka, who stirred a controversy by addressing the Union Minister HD Kumaraswamy as ‘Kaala Kumaraswamy’ has tendered apologies for his remarks.

Speaking to reporters in Mysuru on Tuesday, Minister Zameer stated that he will apologise if remarks have hurt JD-S workers.

“We both are very close. Then, in a total of 24 hours, we were together for 14 hours. He used to fondly address me as “kulla” (shorty) and I used to address him as “kariyanna” (blacky, kaalia),” Minister Zameer stated.

“I am not addressing him as ‘kaalia’ for the first time. I have not said something highly derogatory. It is being made as big in the backdrop of elections. With love, he used to call me a shorty and I called him a blacky. If I had caused pain to anyone by my words I apologise,” he said.

He further stated: “Kumaraswamy had said that he didn’t want the votes of the Muslim community. But now they are attempting to purchase Muslim votes. Against this backdrop, I have made the remark.”

Minister for Home G. Parameshwara stated on Tuesday, “Minister Zameer and Kumaraswamy are close friends. Their comments against each other are not significant.”

Zameer Ahmad Khan, the Tourism and Waqf minister of Karnataka stirred a controversy on Monday as he addressed the Union Minister as ‘Kaala Kumaraswamy’.

JD-S on Tuesday demanded a public apology and resignation of Minister for Waqf and Tourism Zameer Ahmad Khan over his ‘racist’ remarks.

“Remember, there is no place here for your divisive policies. You have insulted the people by making ethnic, racist and discriminatory statements. You should apologize to the people of the state and resign,” the JD (S) demanded in the post.

Union Parliamentary Affairs and Minister for Minority Affairs Kiren Rijiju reacted sternly to the racist jibe and stated, “I strongly deplore Congress Minister Zameer Ahmed calling Union Minister and former Chief Minister of Karnataka Kumaraswamy as 'Kaalia Kumaraswamy'.
