Hijab ban in classroom: Another plea in Supreme Court challenges Karnataka HC verdict

Bengaluru, Mar 17: A fresh plea was filed in the Supreme Court on Thursday challenging the Karnataka High Court verdict which dismissed the petitions seeking permission to wear a Hijab inside the classroom saying Hijab is not a part of the essential religious practice in the Islamic faith.

The petition has been filed by one Sajeeda Begum, who had also sought to get herself impleaded as a party in the proceedings related to Hijab ban before the Karnataka High Court.

The top court on Wednesday said that it would list other pleas on the issue for hearing after Holi vacation.

When senior lawyer Sanjay Hedge, appearing for a student, mentioned the plea for urgent listing on March 16, Chief Justice of India N.V. Ramana had said, “Others also mentioned, let us see...we will list (the petitions) after the vacation. Give us time.” Begum, in her fresh appeal filed through lawyer Talha Abdul Rahman and others, said that the teenage girls covering themselves modestly while going to receive education pose no threat to “public order." “In fact, the threat to law and order is manufactured by hecklers who are to be controlled by the State. The impugned government order would affect young girls' minds forever,” the appeal said.

The plea said that the high court failed to apply the tests applicable to restrictions on the fundamental right to freedom of speech and expression and the fundamental right of privacy without reasons.

The high court treated dress code or uniform prescribed as not involving the issue of breach of the fundamental right, without appreciating that no such uniform has yet been prescribed that takes away the right to wear hijab.

Prior to this, several other pleas including a Muslim student, who was one of the petitioners before the high court, had moved the apex court against the full bench high court verdict on the case in which it was held that wearing hijab is not a part of essential religious practice in Islamic faith under Article 25 of the Constitution.

The high court had dismissed the petitions filed by a section of Muslim students from the Government Pre-University Girls College in Udupi, seeking permission to wear Hijab inside the classroom.

The prescription of school uniform is only a reasonable restriction, constitutionally permissible which the students cannot object to, the high court had said.

In one of the pleas filed in the top court, the petitioner said the high court has “erred in creating a dichotomy of freedom of religion and freedom of conscience wherein the court has inferred that those who follow a religion cannot have the right to conscience.” “The high court has failed to note that the right to wear a Hijab comes under the ambit of the right to privacy under Article 21 of the Constitution of India. It is submitted that the freedom of conscience forms a part of the right to privacy,” it said.

The plea said the petitioner had approached the high court seeking redressal for the alleged violation of their fundamental rights against the state government order of February 5, 2022, issued under Sections 7 and 133 of the Karnataka Education Act, 1983.

The high court had maintained that the government has the power to issue impugned order dated February 5, 2022, and no case is made out for its invalidation.

By the said order, the Karnataka government had banned wearing clothes that disturb equality, integrity, and public order in schools and colleges, which the Muslim girls had challenged in the high court.

Challenging the February 5 order of the government, the petitioners had argued before the high court that wearing the Islamic headscarf was an innocent practice of faith and an Essential Religious Practice (ERP) and not a mere display of religious jingoism.

The petitioners had also contended that the restriction violated the freedom of expression under Article 19(1)(A) and Article 21 dealing with personal liberty.

Mangaluru: Dakshina Kannada MP Captain Brijesh Chowta met Union Home Minister Amit Shah in New Delhi on Friday to discuss key issues affecting the security and development of the region. The meeting highlighted several urgent concerns, ranging from counter-terrorism measures to infrastructure upgrades.

During the meeting, Chowta strongly advocated for establishing a National Investigation Agency (NIA) Centre in Mangaluru. He pointed out the city’s vulnerability to threats such as Islamic radicalisation, sleeper cells, and the activities of groups like SDPI and PFI. Citing the unrest during the Citizenship Amendment Act (CAA) protests, Chowta emphasized the ability of radical groups to incite large-scale disruptions. He argued that Mangaluru’s strategic coastal location necessitates an NIA Centre to bolster counter-terrorism operations and ensure regional security.

Chowta also discussed the Indian Coast Guard Academy, sanctioned for Mangaluru in 2020. He highlighted its potential to enhance India’s maritime security through advanced training in coastal defence, disaster response, and surveillance. Situated near the Arabian Sea and Mangalore Port, the academy is strategically positioned to address challenges in regions like Lakshadweep and the Maldives, aligning with India’s geostrategic interests.

The MP proposed the establishment of a Sainik School in Mangaluru to nurture leadership, discipline, and patriotism among local youth. He emphasized that such an institution would not only provide quality education but also act as a feeder for the armed forces, enhancing the region’s defence readiness. Chowta suggested pairing the school with a military installation, further strengthening coastal defence capabilities and supporting national security goals.

Addressing infrastructure, Chowta underscored the need to improve the Mangaluru-Bengaluru railway and road networks. He argued that enhanced connectivity would unlock the region’s economic potential, streamline logistics for New Mangalore Port, and support key industries such as fisheries, agriculture, and manufacturing. Additionally, upgraded infrastructure would boost trade, tourism, and employment opportunities.

On economic development, Chowta urged the revival of cooperative banks under the Ministry of Cooperatives. He proposed increased funding and loan facilities for businesses and farmers to enhance financial inclusion and regional economic stability. Strengthening fisheries cooperatives, he noted, would provide local fishermen with better access to financial services, loans, and insurance, improving productivity and security.

The MP’s discussions reflected a comprehensive vision for balancing security, infrastructure, and economic growth in Dakshina Kannada, aligning with both regional and national priorities.

Israel has conducted a fresh round of strikes on the southern Gaza Strip city of Khan Yunis, claiming the lives of at least 11 people amid the regime’s unceasing aggression on the Palestinian territory.

Local media said the Israeli onslaught targeted a tented encampment in the al-Mawasi area of western Khan Yunis at dawn on Thursday.

The aggression killed at least 11 people, including three children, and the resulted in the injury of 12 others, with reports naming Major General Mahmoud Salah, the director general of the police department in the Palestinian Interior Ministry in Gaza, among the fatalities.

The occupation forces also struck the central Gaza Strip, where Israeli vehicles fired at the north of Nuseirat refugee camp and shelled the west of the camp with artillery.

The regime’s helicopters also fired at the southwest of Deir al-Balah.

Moreover, the Israeli forces launched a raid targeting Gaza City and the Saftawi area, northwest of the city, as well as the Jabalia camp in the north of the Strip.

The official Palestinian news agency WAFA reported on the first day of the New Year that the Israeli regime had slaughtered 17 Palestinians in the northern Gaza refugee camp of al-Bureij.

Twenty Palestinians were also injured in the Wednesday airstrike.

Israel launched the war on Gaza on October 7, 2023, after Palestinian resistance groups carried out a surprise retaliatory operation into the occupied territories.

So far, Israel has killed 45,553 Palestinians, most of them women and children, and injured 108,379 others.

Most of Gaza’s 2.3 million people have been displaced and much of the besieged territory is in ruins.

Occupation of Gaza City

Citing Israeli media, Turkey’s state-run Anadolu news agency reported on Wednesday that the Israeli regime was considering ordering the military to occupy Gaza City.

Israeli Channel 14 claimed the move comes amid a stalemate in indirect negotiations aimed at reaching a Gaza ceasefire and prisoner swap deal with Palestinians.

“The political echelon is considering issuing an order to the Israeli army to head south and occupy Gaza City in the near future,” the channel said.

“Such an operation is possible now, especially in light of the ceasefire in Lebanon and the availability of more army forces to carry out large-scale and prolonged maneuvers.”

The broadcaster also said Israeli prime minister Benjamin Netanyahu’s cabinet is “satisfied” with the results of its military campaign in northern Gaza.

Mediation efforts led by the US, Egypt, and Qatar to reach a ceasefire in Gaza have so far failed due to Netanyahu’s refusal to halt the protracted war.

In November, the International Criminal Court issued arrest warrants for Netanyahu and his former minister of military affairs Yoav Gallant for war crimes and crimes against humanity in Gaza.

Israel also faces a genocide case at the International Court of Justice for its war on the blockaded territory.

Mangaluru, Jan 8: The serene beaches near Kulai Jetty under the limits of Surathkal police station turned into a scene of tragedy on Wednesday, January 8, as a group of four close friends saw their day of joy morph into heartbreak. 

Three young men lost their lives in the unforgiving waves, while one narrowly escaped death, saved by the heroic efforts of local fishermen.

The victims have been identified as: 

M. S. Manjunath (31), son of Shivlingappa, hailing from Upparigenahalli, Chitradurga district.

Shivakumar (30) from Shivamogga district.

Satyavelu (30) from JP Nagar, Bengaluru.

The sole survivor, Parameshwara (30), from Hangarga, Bidar district, now carries the weight of a harrowing ordeal and the devastating loss of his three closest friends.

These young men, all students of AMC Engineering College in Bengaluru, had embarked on a trip meant to create memories of joy and camaraderie. Driving overnight from Bengaluru, they reached Mangaluru on Wednesday morning. After breakfast at a local eatery, the group decided to visit the picturesque Kulai Jetty, seeking solace and adventure in the sea.

But their joyful outing took a tragic turn. While playing in the water, the four were caught in strong currents. Despite the swift intervention of local fishermen, only Parameshwara could be rescued in time. The lifeless bodies of Manjunath, Shivakumar, and Satyavelu were later found on the right side of the jetty, their dreams and futures cruelly cut short.

The Surathkal police, alerted to the incident, promptly arrived at the scene and began their investigation. The bodies were transported to AJ Hospital for post-mortem examinations, leaving their families and friends to grapple with the enormity of their loss.

A case has been registered at Surathkal Police Station. This incident serves as a stark reminder of the unpredictable and dangerous nature of the sea, urging visitors to prioritize safety above all else.

What was meant to be a day of joy has left a void that can never be filled, as three grieving families now face the unbearable pain of losing their loved ones.
