If Rama’s birth at Ayodhya can’t be doubted, why triple talaq: Sibal in SC

New Delhi, May 16: The Supreme Court on Tuesday continued its hearing on a bunch of petitions relating to the practice of triple talaq, with the All India Muslim Personal Board presenting its case in the court.

Senior Congress leader and advocate Kapil Sibal, representing the AIMPLB, argued that a tradition like triple talaq, which is centuries old, cannot be termed unconstitutional all of a sudden.

“Triple talaq is going on since 1,400 years, how can you say it is unconstitutional? It's a matter of faith,” Sibal told the apex court bench.

Furthering his argument, Sibal said, “There is no question of constitutional morality and equity in matters of faith”.

Also making a reference to the Ayodhya temple issue, Sibal pointed out that if Hindus' faith about Lord Rama is not arguable, Muslims' faith in triple talaq should also not be questioned

"If Hindus faith about Rama's birth at Ayodhya can't be questioned, then triple talaq, a matter of faith for Muslims shouldn't be (questioned too)," said Sibal

He also referred to the fact that the source of triple talaq can be found in Hadith and that it came into being after the time of Prophet Muhammad.

Sibal further remarked that the court should not be hearing the case in the first place. The advocate said so when Justice Rohinton Fali Nariman, one of the five judges constituting the bench asked if they should not hear the matter at all, following his non-interference in faith reasoning.

The apex court, however, asked the AIMPLB to state its opinion on the position of e-talaq in Islam, given through Whatsapp messages.

Earlier, The Centre on Monday had informed the Supreme Court that it would bring a law to regulate marriage and divorce among Muslims if the court held triple talaq invalid and unconstitutional.

Attorney General Mukul Rohatgi, India’s top law officer, made this submission after a five-judge constitution bench asked him about the remedies for Muslim men if triple talaq was struck down.

The multi-faith bench comprising Chief Justice of India JS Khehar and Justices Kurian Joseph, Rohinton Nariman, Uday Lalit and Abdul Nazeer is examining the legality of triple talaq after a clutch of petitions for a ban on the practice was filed.

The AG said triple talaq was not fundamental to Muslim personal law, and as the guardian of fundamental rights, the court should protect the rights of half of the Muslim population, which suffers discrimination.

The CJI told the AG, “We (court) are guardians of fundamental rights as well as minority rights. We agree with you that if triple talaq is arbitrary, extra-judicial, it must go. But we are not here to tinker with religion, tenets of religion and religious practices. Tenets of religion can never be tested by courts. What we may ultimately decide will impact a large section of the population.”

The Narendra Modi government at the Centre has been pushing for a ban on the contentious practice on grounds of gender equality and justice. The push also looks to win support from Muslim women and chip away at an important bloc of voters that has viewed Modi with suspicion. The All India Muslim Personal Law Board has promised reforms in personal law but opposed a blanket ban on the practice.

Udupi, Nov 7: In a tragic turn of events, a young woman, Prasanna, aged 29, allegedly died by suicide on Wednesday, struggling to cope with the demands of work and motherhood after the birth of her daughter, according to police reports.

Prasanna had married on December 2, 2022, and was the mother of a 10-month-old baby girl. Her husband works in Bengaluru, while she lived with her in-laws, who, according to her family, treated her kindly.

In a complaint, Prasanna's mother revealed that her daughter often called her, expressing deep concerns over her readiness for motherhood. Despite receiving supportive care from her family, Prasanna felt unprepared and overwhelmed by the balance of work and home life that early motherhood required.

Her family shared that she had been undergoing treatment, but between 10 a.m. and 1:45 p.m. on Wednesday, she allegedly took her own life at her husband’s residence. The Karkala Rural Police Station has registered a case and is conducting further investigations.

Mangaluru: A tragic accident took place on Saturday at Chembugudde near Thokkottu, claiming the life of a 47-year-old woman after a tanker lorry ran over her. The victim, identified as Rahmat H Rashid, was riding pillion with her husband, Abdul Rashid G, on their scooter. 

The couple was traveling from Yenepoya Hospital to Bajpe when the scooter skidded on the poorly maintained road. Rahmat fell onto the road and was fatally struck by a tanker lorry that was coming from behind. Despite being rushed to the hospital, doctors declared her dead upon arrival.

The incident prompted a swift response from the DYFI Ullal Taluk Committee, which staged a protest on Saturday night, condemning the unsafe condition of the road. Nithin Kuthar, president of the committee, criticized MLA and Legislative Assembly Speaker UT Khader for failing to ensure safe infrastructure, despite touting the road as toll-free. 

Kuthar demanded immediate repairs, warning that the committee would march to the MLA’s office with black flags if the road is not fixed within a week.

Former DYFI State President Sunil Kumar Bajal also voiced frustration over the deteriorating condition of Thokkottu market, highlighting the struggles people face while crossing roads riddled with dangerous potholes. In response to public outcry, temporary repairs were made to the road at Chembugudde on Sunday, though locals remain wary and demand a more permanent solution.

In a tragic turn of events, a young spectator lost his life during a bull-taming event, Kobbari Hori, at Chigalli in Mundgod taluk, Uttara Kannada, on Saturday. 

Parameshwar Siddappa Harijan, aged 22, was fatally gored by a marauding bull during the event, which had drawn large crowds as part of the Deepavali festival celebrations.

With thousands of spectators lining the path to witness the action, the event took a horrific turn when the bull charged directly at Parameshwar, inflicting severe injuries. 

Despite efforts to rush him to the hospital, Parameshwar tragically succumbed to his wounds on the way.

In response to the fatal accident, another bull-taming event scheduled for the evening in Mundgod town was promptly cancelled, as shock and grief swept through the community following the heartbreaking incident.
