No sanction to prosecute Yogi in 2007 riots: UP govt tells HC

Allahabad, May 11: The Uttar Pradesh government today informed the Allahabad High Court that it has refused to grant sanction for the prosecution of Chief Minister Yogi Adityanath in a decade-old communal riots case.

An affidavit stating that sanction has been "refused" for prosecuting Adityanath in the case related to the Gorakhpur riots of 2007 - when he was the local MP - was filed before the court by Chief Secretary Rahul Bhatnagar.

The chief secretary had been asked to appear in person by an order dated May 7 by a division bench comprising justices Ramesh Sinha and Umesh Chandra Srivastava.
In his affidavit, Bhatnagar also stated that the CB-CID, which has been investigating the case registered in connection with the riots, has proposed to submit its closure report and it will be submitted before the trial court.

"We challenged the state government's stand and submitted before the court that the chief secretary happens to be a subordinate of the chief minister, who is himself an accused. The refusal to grant sanction tantamount to an accused declining to prosecute himself, which has no parallel in the world," the petitioners' counsel S F A Naqvi told PTI.

He said "we also pointed out that Yogi Adityanath has himself, in an interview to a private news channel, which is available on YouTube, admitted to having made the incendiary speeches for which he has been named in the FIR lodged at Gorakhpur. We requested that the court summon the video recording to get a first-hand impression."

"The court responded to our submission by asking the state government to file an affidavit on the next date of hearing explaining why a recording of the said interview not be summoned," he said.

"We also sought permission to file an application challenging the state government's order refusing to the grant sanction for prosecuting Yogi Adityanath. The court gave permission to do so by the next date of hearing on July 7," the counsel added.

The petition was filed by Parvez Parwaz, the complainant in the FIR lodged in connection with the riots at Cantt police station of Gorakhpur; and Asad Hayat, a witness in the case in which the then city Mayor Anju Chaudhary and BJP MLA Radha Mohan Das Agrawal have also been named as accused.

The petitioners have moved the high court seeking an investigation into the case by an independent agency.

Mangaluru: The Mangalore International Airport (MIA) will connect to a new domestic destination with the introduction of a non-stop flight to Tiruchirappalli International Airport in Tamil Nadu. 

The non-stop service, once-a-week, will operate on Wednesday (from TIA) and Thursday (from MIA), starting April 3. Air India Express will operate the flight.

The flight is expected to help those taking up a pilgrimage to Vailankani shrine.

Sources from the AIE said that the airline carrier decided to fly non-stop between the two southern Indian cities as a flight to Jeddah, which will start from April 3, arrives from Tiruchirappalli International Airport. 

“It is a ferry or positional flight from TIA to MIA. Instead of flying empty, the management has decided to run it as a commercial flight. This will help both passengers and the airline. The airline will deploy Boeing 737-800 aircraft with a 186-seater all-economy configuration on this route. 

The same flight, after landing in MIA, will further fly to Jeddah,” a source said. 

The flight IX 1498 will depart every Thursday at 5am from MIA to TIA. The TIA-MIA flight IX 1499 departs at 12.50pm. It is a one-hour nonstop flight. The same flights will also operate nonstop between Jeddah and MIA. 

The non-stop flight IX 499 will depart MIA at 2.50pm and reach King Abdulaziz International Airport, Jeddah at 6.25pm. The IX498, will depart from Jeddah at 7.25pm and reach MIA early at 3.40am.

Bengaluru, Mar 15: Former Karnataka chief minister and senior BJP leader B S Yediyurappa was booked under the Protection of Children from Sexual Offences (Pocso) Act on Thursday for allegedly sexually assaulting a minor at his residence in Bengaluru last month.

Yediyurappa, 81, was booked after a woman lodged a complaint saying that she visited his residence on February 2 seeking justice in a rape case against her daughter and sought that a special investigation team (SIT) be formed to look into the case.

According to the first information report (FIR), Yediyurappa allegedly took the minor to a room, closed the door and sexually assaulted her. The woman further alleged in the FIR that when she confronted Yediyurappa, he said that he was checking if the girl was raped or not. Yediyurappa later allegedly apologised and asked the woman not to reveal the matter to anyone.

The Sadashivanagar police in Bengaluru have registered a case under Section 8 (commit sexual assault) of the Pocso Act and Section 354 (a) (sexual harassment) of the Indian Penal Code (IPC).

Reacting to the allegations, the former CM said that around one-and-a-half months ago, they (the victim and her mother) had come to his house seeking help and he had taken them inside. 

“After listening to her, I called the city police commissioner B Dayananda over phone seeking to address her problem. Later, they spoke against me and I then suspected that there is some health problem with her. I sent them to city police commissioner’s office. I even gave her some money as they were in distress. I came to know that an FIR has been registered and will look into it. But this is what I get for helping someone,” he added.

Mangaluru, Mar 28: A fish meal factory in the Baikampady Industrial area in Mangaluru was gutted in a fire incident on Thursday, officials said.

The factory is owned by the company 'Shihar Enterprises', they said.

According to the locals, the fire was first noticed at 4.45 am today, which was immediately reported to the fire department.

The fire engines reached the spot and tried to douse the fire, but it had already spread to other parts of the factory. After almost four hours of fire-fighting operation, the blaze was completely doused, officials.

The reason for the blaze is still being probed, the fire department officials said, adding that they suspect an electric short circuit could have triggered it.
