Babri Masjid case became weaker as CBI did not probe Pakistan’s role in demolition: Special Judge!

Lucknow, Oct 1: A special court here has said the Central Bureau of Investigation did not probe on an “information” that people from Pakistan intelligence agency may have also entered and damaged Babri Masjid in Ayodhya to foment communal disturbances in the country.

Special Judge S K Yadav referred to inconsistencies in testimonies of several prosecution witnesses while holding that the charge of criminal conspiracy to demolish the structure and other charges were not proved against 32 high-profile accused in the case.

In the 2,300 page-long verdict written in Hindi, the judge said the CBI case became weaker or "forceless" in view of the fact that it did not probe and ruled out the Pakistan angle to the demolition to make the criminal conspiracy charge stand the judicial scrutiny. 

The special CBI judge observed this on Wednesday in the judgement while acquitting the accused, including veteran BJP leaders L K Advani and M M Joshi, of conspiring to raze the structure among other charges.

The court said the CBI's allegations against the accused persons "become forceless also because it did not investigate a report sent by Local Intelligence Unit (LIU) on December 5, 1992, that on December 6, 1992, some persons from Pakistani intelligence agencies may cause damage to the disputed structure after merging with the local crowd".

It noted that there were local intelligence reports that on December 2, 1992, itself some 'mazaar' (shrine) were broken and set on fire by persons from the Muslim community with an aim to vitiate the communal atmosphere so that 'kar seva' may be interrupted.

It cited an LIU report, which was signed by Inspector General (security), Uttar Pradesh, that said "persons related to Pakistani intelligence agencies have merged with the masses in Ayodhya and they may create unrest in the state and the country by damaging the disputed structure with explosives and other means".

The court also noted that there were reports that explosives originated from Pakistan had reached Ayodhya via Delhi, while another intelligence report had warned the administration that "about 100 persons, including anti-social/anti-national elements, from Udhampur area of Jammu and Kashmir are coming to Ayodhya in the garb of kar sevaks."

The reports were received by authorities concerned and acted upon, the court observed.

"This information was sent to Principal Secretary (Home), Uttar Pradesh, and the state's all security agencies were informed about the same in written form. "Despite having such crucial information, these aspects were not investigated," the judge said.

The case is related to the razing of the disputed structure in Ayodhya on December 6, 1992, which triggered riots for several months leaving nearly 2,000 people dead across the country.

The structure was demolished by self-proclaimed 'kar sevaks' who claimed that the 16th century Babri mosque in Ayodhya was built on the site of an ancient Ram temple.

The 32 accused include former deputy prime-minister Advani, former Union ministers Joshi and Uma Bharti, former Uttar Pradesh chief minister Kalyan Singh during whose tenure the structure was pulled down, besides Vishva Hindu Parishad leaders Vinay Katiyar and Sadhvi Rithambara.

Charges were framed against 49 people, but 17 (including stalwarts like Ashok Singhal, Balasaheb Thackeray, Vijayraje Scindia) have died during the course of the trial.

The serious criminal conspiracy charge against the accused was first dropped by the trial court in 2001. The verdict was upheld by the Allahabad High Court in 2010, but the Supreme Court ordered restoration of the conspiracy charge against the accused on April 19, 2017.

The charge of conspiracy was in addition to other charges, including promoting enmity between different groups on grounds of religion.

The CBI had argued that the accused conspired and instigated 'kar sevaks' to demolish the 16th century mosque.

However, the accused had pleaded innocence, maintaining there is no evidence to prove their guilt and claiming that they were implicated by the then Congress government at the Centre as political vendetta.

The UN special rapporteur for Palestine has slammed Israel’s parliament for passing a law authorizing the detention of Palestinian children, who are “tormented often beyond the breaking point” in Israeli custody.

Francesca Albanese, the UN special rapporteur on the rights situation in the Occupied Palestinian Territory, in a Thursday post on X, characterized the experiences of Palestinian minors in Israeli detention as extreme and often inhumane.

The UN expert highlighted the grave impact of this policy, noting that up to 700 Palestinian minors are taken into custody each year, a practice she described as part of an unlawful occupation that views these children as potential threats.

Albanese said Palestinian minors in Israeli custody are “tormented often beyond the breaking point” and that “generations of Palestinians will carry the scars and trauma from the Israeli mass incarceration system.”

She further criticized the international community for its inaction, suggesting that ongoing diplomatic efforts, which often rely on the idea of resuming negotiations for peace, have contributed to normalizing such human rights violations against Palestinian children and the broader population.

The comments by Albanese came in response to Israel’s parliament (Knesset) passing a law on November 7 that authorizes the detention of Palestinian children under the age of 14 for “terrorism or terrorist activities.”

Under the legislation, a temporary five-year measure, once the individuals turn 14, they will be transferred to adult prison to continue serving their sentences.

Additionally, the law allows for a three-year clause that enables courts to incarcerate minors in adult prisons for up to 10 days if they are considered dangerous. Courts have the authority to extend this duration if necessary, according to the Knesset.

The legislation underscores a shift in the treatment of minors and raises alarms among human rights advocates regarding the legal and ethical ramifications of detaining children and the conditions under which they may be held.

Thousands of Palestinians, including hundreds of children and women, are currently in Israeli jails—around one-third without charge or trial. Also, an unknown number are arbitrarily held following a wave of arrests in the wake of the regime's genocidal war on Gaza.

Since the onset of the Gaza war, the Israeli regime, under the supervision of extremist minister Itamar Ben-Gvir, has turned prisons and detention centers into “death chambers,” the ministry of detainees and ex-detainees’ affairs in Gaza says.

Violence, extreme hunger, humiliation, and other forms of abuse of Palestinian prisoners have been normalized across Israel’s jail system, reports indicate.

Over 270 Palestinian minors are being detained by Israeli authorities, in violation of UN resolutions and international treaties that forbid the incarceration of children, as reported by Palestinian rights organizations.

After the US prosecutors charged Gautam Adani with bribery and fraud, Congress reiterated its call for a Joint Parliamentary Committee (JPC) probe into the transactions of the Adani group, and hit out at Prime Minister Narendra Modi, alleging an "internal nexus" between him and "his favourite businessman."

Senior Congress leader Jairam Ramesh said the indictment of Gautam Adani and others by the US Securities and Exchange Commission validates his party’s call for a Joint Parliamentary Committee investigation.

The Congress has been pushing for the probe since January 2023, raising concerns over alleged irregularities involving Adani and his business dealings, said Ramesh.

Ramesh referred to the party’s “Hum Adani ke Hain” series, where 100 questions were raised about the alleged scams and the links between Prime Minister Narendra Modi and Gautam Adani.
He noted that the questions remain unanswered, reiterating the need for accountability in the matter.

The US prosecutors have charged Adani with deceiving investors by concealing information about his firm's solar energy project in India, which allegedly involved bribery.

Adani has been charged with securities fraud and conspiracy, according to an indictment unsealed on Wednesday. The case focusses on an agreement between Adani Green Energy Ltd. and another organisation to supply 12 gigawatts of solar power to the Indian government.

'BETRAYAL OF INDIAN INVESTORS'

Congress leader Pawan Khera described the allegations against Gautam Adani and his conglomerate as a “betrayal of Indian investors.”

Taking to X, Khera outlined the US charges, including claims that Adani’s group bribed Indian government officials between 2020 and 2024 to secure contracts. Citing media reports, he also pointed out that Gautam Adani personally met a government official to advance the scheme.

Khera referred to a March 2024 incident where the Adani Group allegedly misled the Bombay Stock Exchange and the National Stock Exchange, calling it a “grave violation of investor trust.”

He further highlighted a March 2023 FBI raid on the premises of Sagar Adani, Gautam Adani’s nephew, where electronic devices were seized as part of the investigation.

'SEBI NOT ABLE TO PROVE ANY CHARGES AGAINST ADANI'

Shiv Sena (UBT) leader Priyanka Chaturvedi criticised central probe agencies following US charges against Gautam Adani and others in an alleged bribery case linked to solar energy contracts.

Chaturvedi raised concerns about corporate governance and regulatory oversight in the country. “They talk about corporate governance, responsibility, and accountability. The industrialists should be asked to follow the rules and regulations, but even the agencies were defending him. The SEBI has not yet been able to prove charges against him,” she said, pointing to what she viewed as failures in ensuring accountability.

'BROUGHT DISREPUTE TO INDIA'

On US charges against Gautam Adani, AAP leader Sanjay Singh called for a probe against the industrialist. He said that the probe should be conducted by an investigation agency under the Supreme Court.

"Adani Group has brought disrepute to India. This is a very serious matter. The PM of India should come forward and answer this. All the pending matters against Adani should be probed by an investigation agency under Supreme Court monitoring, and all the corruption done by him, within and outside the country, should come out before the country and action should be taken against him," he said.

BJP DFENDS

BJP IT cell chief Amit Malviya responded sharply to the Opposition’s criticism regarding allegations involving Adani Green Energy and US-based Azure Power. He pointed out that the charges in the indictment are only allegations and emphasised, “The defendants are presumed innocent unless and until proven guilty.”

Malviya argued that the crux of the case concerns agreements to supply 12 GW of power to the Solar Energy Corporation of India (SECI), contingent on SECI securing power purchase agreements with state electricity distribution companies (SDCs).

Bengaluru: The Janata Dal (Secular) is grappling with its most tumultuous political crisis yet, with speculation rife about imminent defections among its lawmakers. This storm comes in the aftermath of party scion Nikhil Kumaraswamy's humiliating defeat in the Channapatna bypoll—his third consecutive electoral loss after setbacks in Mandya (2019) and Ramanagara (2023). With the regional party’s Assembly tally shrinking to 18 from 19, questions are being raised about its survival.

The murmurs of rebellion were amplified on Monday when Health Minister Dinesh Gundu Rao and Congress MLA CP Yogeshwar openly hinted at possible desertions within the JD(S) ranks. Yogeshwar, newly elected from Channapatna, declared he could orchestrate a migration of JD(S) MLAs to Congress. “I’ll meet them at the Belagavi session. Within a month, they’ll be in Congress,” he confidently stated during a televised interview. Yogeshwar has a history of engineering defections, having played a pivotal role in the collapse of the JD(S)-Congress coalition government in 2019 during his stint with the BJP.

Dinesh Gundu Rao, not mincing words, slammed the JD(S) leadership for fostering "self-serving politics," criticizing the HD Deve Gowda family for failing to nurture party talent. “There’s no trust. Their MLAs will seek survival—either in BJP or Congress,” he remarked.

Meanwhile, the expelled JD(S) state president CM Ibrahim added fuel to the fire by claiming that 12-13 MLAs are "disillusioned" with the current leadership. Speculations around senior JD(S) leader GT Deve Gowda joining Congress have also intensified. DK Shivakumar, Karnataka’s Deputy CM and Congress president, described GT Deve Gowda as a “valuable leader” who might be frustrated with the party’s internal dynamics.

While Congress leaders seem eager to poach JD(S) legislators, the BJP is not far behind in targeting the floundering party. The situation signals a decisive moment for the JD(S), as its survival now hinges on how it manages this brewing storm of discontent.
