Gyanvapi masjid case: Court allows ASI survey of entire mosque as per Hindu side's demand

A Varanasi court on Friday, July 21, granted permission for the scientific survey of the Gyanvapi mosque complex, located next to the Kashi Vishwanath temple.

The petition filed in the case by the Hindu side had sought a direction to the Archaeological Survey of India (ASI) to survey the entire mosque complex.

A videographic survey of the Gyanvapi complex in May last year had revealed what the Hindu side claimed was a 'shivling' inside the mosque premises. The Muslim side has insisted that the structure is merely a fountain.

The Varanasi court, however, said the wuzukhana (place for ablution) where the 'Shivling' was found, should be kept out of the purview of the ASI's "scientific survey".

The ASI has been directed to produce a study report before the court by August 4.

The court of District Judge A K Vishwesha further ordered the scientific survey by ASI to take place between 8am-12noon.

The court clarified there will be no restrictions on Namaz and no damage should be caused to the Gyanvapi mosque.

'Turning point in case'

Hailing the order, Vishnu Shankar Jain, the counsel for the Hindu side, said this was a "turning point" in the case.

Jain said he had argued in court that the Kashi Vishwanath temple-Gyanvapi mosque dispute can be resolved only by an archaeological investigation of the entire mosque complex and that it was crucial to "uncover whether the current structure (Gyanvapi mosque) was built on barren land or was constructed over a pre-existing structure of a Hindu temple".

"It is also important to examine the age and nature of the construction of the western wall of the building and domes to check whether the top of temples existed beneath them. Besides, marks of Swastik, verses of shlokas evident on many walls and many other facts should also be examined," he told the court.

The lawyer said the situation can become clear after examining "in a modern way" the three domes of the Gyanvapi complex, the western wall of the complex and the entire complex.

Yellapura: A devastating accident occurred early Wednesday morning in the Uttara Kannada district of Karnataka, leaving at least 10 people dead and several others critically injured. The tragedy unfolded near the Kageri petrol station in Yellapur when a truck carrying fruits and vegetables plunged into a valley and overturned.

The truck, which was transporting over 40 traders, was en route from Savanuru in Haveri district to Kumta market in Uttara Kannada. Among the passengers were fruit vendors heading to the Yellapura fair to sell their produce. The accident occurred on the Savanur-Hubballi road, as confirmed by M. Narayana, the Superintendent of Police of Uttara Kannada.

“At approximately 5:30 a.m., the truck driver attempted to give way to another vehicle and veered too far to the left, causing the truck to fall into a valley approximately 50 meters deep,” said SP Narayana.

Upon receiving information about the accident, police rushed to the scene and coordinated the rescue operations. The injured were swiftly transported to KIMS Hospital in Hubballi for treatment. Tragically, eight individuals died on the spot, while another succumbed to critical injuries shortly after. The absence of a protective wall on the road in the valley has been highlighted as a contributing factor.

“Many passengers sustained serious injuries, and the death toll could rise,” said police officials. Investigations are ongoing to determine the exact cause of the accident.

This tragic incident has left the local community in shock, as families and friends mourn the loss of lives. Authorities are urging caution and have reiterated the need for safety measures on roads in vulnerable areas. Further updates on the condition of the injured are awaited.

Ahead of the Delhi Assembly elections, Aam Aadmi Party (AAP) national convenor and former Delhi Chief Minister Arvind Kejriwal has written to Prime Minister Narendra Modi, urging the Centre to prioritise waiving loans for farmers and the middle class instead of wealthy individuals. He also demanded a nationwide law to prohibit the waiver of loans given to billionaires.

Notably, Delhi Assembly elections are scheduled for February 5 and the result will be announced on February 8. Kejriwal is seeking a third consecutive term, following AAP's landslide victory in 2020 when it won 62 out of 70 seats.

Income tax, GST rates can be cut to half

Addressing a press conference on Tuesday, Kejriwal criticised the central government, alleging favouritism toward the wealthy by writing off corporate loans worth thousands of crores. He claimed such practices burden ordinary citizens with excessive taxes while benefitting the rich. "Common people are paying half their salaries in taxes, while the loans of the rich are being waived. Why doesn't the central government waive home loans, car loans, or other financial burdens of ordinary citizens?" Kejriwal asked.

He emphasised that discontinuing loan waivers for billionaires could enable the government to reduce income tax and GST rates by half, double the taxable income threshold, and remove GST on essential commodities. "This is a massive scandal, and it's time to put an end to it," he said.

Kejriwal writes to PM Modi 

In his letter, Kejriwal stated, "Prime Minister should declare that no rich person's loan will be waived off. If you want to waive off, then waive off farmers' loans, middle class's home loans. This money will benefit the middle class a lot."

Kejriwal further argued that by waiving loans for the wealthy, the government could reduce tax rates. "I have calculated that if loans are not waived off, then tax rates will be halved. A person earning 12 lakhs annually pays his entire salary in tax, this is the sorrow of the middle class," Kejriwal wrote.

Justice Vivek Agarwal’s ruling emphasized that the amended Enemy Property Act, 2017, provides a statutory mechanism for resolving disputes. The court noted, “If a representation is filed within 30 days from today, the appellate authority shall not advert to the aspect of limitation and shall deal with the appeal on its own merits.”

The Enemy Property Act enables the central government to claim properties belonging to individuals who migrated to Pakistan after Partition. In this case, the focus lies on the migration of Abida Sultan, the eldest daughter of Hamidullah Khan, the last ruling Nawab of the princely state of Bhopal, to Pakistan in 1950. While Sajida Sultan, Hamidullah Khan’s second daughter, stayed in India and became the legal heir, the government has argued that Abida Sultan’s migration classifies the properties as "enemy property."

Saif Ali Khan, Sajida Sultan’s grandson, inherited a portion of these assets. Although the court recognized Sajida Sultan as the legal heir in 2019, the latest ruling has reignited the family’s decades-long property dispute.

Bhopal Collector Kaushalendra Vikram Singh has announced plans to review ownership records spanning the past 72 years. He also stated that individuals residing on the disputed properties may be classified as tenants under the state’s leasing laws. This decision has caused widespread anxiety among the estimated 1.5 lakh residents in the area, many of whom fear eviction.
