SC stays implementation of new farm laws for now; to form panel to resolve conflict

New Delhi, Jan 12: The Supreme Court on Tuesday suspended implementation of the new farm laws until further orders and said it will form a committee to hold talks with all stakeholders, after hearing petitions challenging the agriculture reforms.

The bench, headed by Chief Justice SA Bobde, has asked all parties to recommend names for forming the committee.  The bench has decided to set up a four-member committee to look into farmers' grievances. It will comprise of agriculture economist Ashok Gulati, international policy head Dr Pramod Kumar Joshi, Shivkeri Sangathna's Anil Dhanvat, and BKU's president Bhupinder Singh Maan.

The top court asserted that it has the power to suspend the contentious legislation to solve the problem and no power can prevent it from making a committee to resolve the impasse on new farm laws.

The top court is inclined to pass an order that all protestors be moved to one common site. Senior advocate Vikas Singh recommended either Ramlila Maidan or Boat Club for this purpose. The court has also decided to serve notices to all farm unions on a Delhi police application that wants a ban on proposed tractor rally by farmers on January 26.

Advocate AP Singh, appearing for one of the farm unions said that his clients have agreed that no elders, women or children will participate in the protests. Chief Justice Bobde said he will take this assurance on record for all protesting unions.

Senior advocates Colin Gonsalves, Dushyant Dave and advocates Prashant Bhushan, HS Phoolka who represent the bulk of farmer unions haven't joined the hearing yet. The Chief Justice and lawyers in favour of the farm laws are repeatedly wondering why Dave, Gonsalves, Phoolka and Bhushan aren't joining the hearing as the four had assured the court yesterday that they will discuss yesterday's proceedings with their clients and revert to the court.

The top court sought the cooperation of farmers' unions, and said that "those who genuinely want resolution, will go to the committee". 

"This is not politics. There is a difference between politics and judiciary and you will have to cooperate", the court asserted to farmer unions.

A note released by the umbrella body Samyukt Kisan Morcha late last night clarified that protesting farmers will not participate in any committee proceedings as proposed by the top court. "While all organisations welcome the suggestions of the honourable Supreme Court to stay the implementation of the farm laws, they are collectively and individually not willing to participate in any proceedings before a committee," it said.

The government also told the apex court that Khalistanis have infiltrated farmer protests. The Attorney General said that he will file an affidavit, with IB reports, detailing the involvement of Khalistanis and other banned outfits in farmer protests.

The top court heard a clutch of pleas opposing the contentious agriculture reforms yesterday. A bench, headed by Chief Justice SA Bobde, said during the hearing that orders on issues concerning the farm laws and farmers' protest will be delivered in parts. 

The matter pertaining to the farm laws was listed for January 12, 2021, as per information uploaded on the website after the hearing, as negotiations between the Centre and farmer leaders remain at a standstill. 

The bench, which also comprised of justices A S Bopanna and V Ramasubramanian, expressed disapproval over the manner by which the three recent farm laws were passed by Parliament.

"We don't know whether you are part of the solution or part of the problem", the Supreme Court said to the Centre during the proceedings on Monday. 

It also indicated amply that it may go to the extent of staying the implementation of the contentious farm laws and refused to grant extra time to the Centre to explore the possibility of amicable solution saying it has already granted the government a “long rope”. It reiterated the possibility of setting up a committee to resolve the issue. 

Protesting farmers have been camping out at Delhi borders since November, demanding a complete repeal of the new laws. Bhog Singh Mansa, president of Indian Farmers Union (Mansa), said a stay on the laws is "no big deal".
"A stay is not a solution. We are here to get these laws scrapped completely... the government has in a way already agreed to scrap the laws when it said it is willing to incorporate as many amendments as farmers want," he said.

"We appeal to the Supreme Court to terminate these laws as these are not valid constitutionally," Mansa said, adding the protest will continue till the "the laws are not repealed or the BJP government completes its tenure".

The eighth round of talks between the Centre and the farmer unions on January 7 headed nowhere as the Centre ruled out repealing the contentious laws while the farmer leaders said they are ready to fight till death and their "ghar waapsi will happen only after law waapsi".

The Taliban regime has appointed Ikramuddin Kamil as the acting consul in the Afghan mission in Mumbai, Afghan media has reported.

It is the first such appointment made by the Taliban set up to any Afghan mission in India.

There was no immediate comment from the Indian side on the appointment that came.

The Ministry of Foreign Affairs of Afghanistan has announced the appointment of Kamil as the acting consul in Mumbai, the Taliban-controlled Bakhtar News Agency reported on Monday, citing unnamed sources.

"He is currently in Mumbai, where he is fulfilling his duties as a diplomat representing the Islamic Emirate," it said.

The appointment is part of Kabul's efforts to strengthen diplomatic ties with India and enhance its presence abroad, the media outlet said

Kamil holds a PhD degree in international law and previously served as the deputy director in the department of security cooperation and border affairs in the foreign ministry, it said.

He is expected to facilitate consular services and represent the interests of Afghanistan in India, the report added.

Kamil's appointment comes days after the external affairs ministry's point-person for Afghanistan held talks with the Taliban's acting defence minister, Mullah Mohammad Yaqoob, in Kabul.

Sher Mohammad Abbas Stanikzai, the Taliban's deputy foreign minister for political affairs, also posted on X about Kamil's appointment.

The appointment of Kamil is seen as part of efforts to facilitate consular services to the Afghan population in Mumbai.

There has been almost negligible presence of diplomatic staff at the Afghan missions in India.

Most of the diplomats appointed by the Ashraf Ghani government have already left India.

In May, Zakia Wardak, the seniormost Afghan diplomat in India, resigned from her position after reports emerged that she was caught at the Mumbai airport for allegedly trying to smuggle 25 kg of gold worth Rs 18.6 crore from Dubai.

Wardak had taken charge as the acting ambassador of Afghanistan to New Delhi late last year, after working as the Afghan consul general in Mumbai for more than two years.

She took charge of the Afghan embassy in New Delhi last November, after the mission helmed by then ambassador Farid Mamundzay announced its closure.

Mamundzay, who was an appointee of the Ghani government, had moved to the United Kingdom.

An Israeli airstrike on the office of Syria’s Baath party in Lebanon’s capital Beirut has killed the Lebanese resistance movement Hezbollah's Media Relations Officer, Mohammad Afif, reports say.

Lebanon's National News Agency (NNA) reported that the Israeli raid struck the Ba'ath party’s building in central Beirut district of Ras Al-Naba'a on Sunday, adding that the strike was an attempt to assassinate the leader of the resistance media front.

According to Baath Secretary-General Ali Hijazi, Afif was having a meeting in the Baath Party headquarters when Israel carried out the attack.

"Afif did not fight with weapons and did not lead a military unit in Hezbollah. Rather, he led a media unit," he said.

Reuters, Sky News, Al Jazeera and a number of Henrew-language media reported that Afif was killed in the Israeli strike.

However, Hezbollah has not yet confirmed Afif’s death or whether he was present at the site or not.

Earlier, the Lebanese Health Ministry said at least one person was killed and three others injured after an Israeli strike targeted a central district in Beirut.

Lebanon's al-Mayadeen television network reported that five people were killed in the attack.

The latest development came after Afif said Hezbollah was behind the Caesarea operation and targeting Netanyahu’s home during a speech at the Ghobeiry area in the southern suburbs of Beirut on October 22.

This was the second assassination attempt on Afif in the last two months, after he survived an attack on the Hezbollah media relations office several weeks ago.

Israel launched a ground assault and massive air campaign against Lebanon in late September after a year of exchanging fire across the Lebanese border in parallel with the Gaza war.

At least 3,287 people have been killed in Israeli strikes in Lebanon over the past year, with the vast majority in the past seven weeks. Another 14,222 have been wounded, mostly women and children.

In response to the ongoing aggression, the Lebanese resistance movement Hezbollah has been staging hundreds of retaliatory strikes against the occupied Palestinian territories and the Israeli forces trying to advance on southern Lebanese areas.

The movement has vowed to sustain its strikes until the regime ends the escalation.

After the US prosecutors charged Gautam Adani with bribery and fraud, Congress reiterated its call for a Joint Parliamentary Committee (JPC) probe into the transactions of the Adani group, and hit out at Prime Minister Narendra Modi, alleging an "internal nexus" between him and "his favourite businessman."

Senior Congress leader Jairam Ramesh said the indictment of Gautam Adani and others by the US Securities and Exchange Commission validates his party’s call for a Joint Parliamentary Committee investigation.

The Congress has been pushing for the probe since January 2023, raising concerns over alleged irregularities involving Adani and his business dealings, said Ramesh.

Ramesh referred to the party’s “Hum Adani ke Hain” series, where 100 questions were raised about the alleged scams and the links between Prime Minister Narendra Modi and Gautam Adani.
He noted that the questions remain unanswered, reiterating the need for accountability in the matter.

The US prosecutors have charged Adani with deceiving investors by concealing information about his firm's solar energy project in India, which allegedly involved bribery.

Adani has been charged with securities fraud and conspiracy, according to an indictment unsealed on Wednesday. The case focusses on an agreement between Adani Green Energy Ltd. and another organisation to supply 12 gigawatts of solar power to the Indian government.

'BETRAYAL OF INDIAN INVESTORS'

Congress leader Pawan Khera described the allegations against Gautam Adani and his conglomerate as a “betrayal of Indian investors.”

Taking to X, Khera outlined the US charges, including claims that Adani’s group bribed Indian government officials between 2020 and 2024 to secure contracts. Citing media reports, he also pointed out that Gautam Adani personally met a government official to advance the scheme.

Khera referred to a March 2024 incident where the Adani Group allegedly misled the Bombay Stock Exchange and the National Stock Exchange, calling it a “grave violation of investor trust.”

He further highlighted a March 2023 FBI raid on the premises of Sagar Adani, Gautam Adani’s nephew, where electronic devices were seized as part of the investigation.

'SEBI NOT ABLE TO PROVE ANY CHARGES AGAINST ADANI'

Shiv Sena (UBT) leader Priyanka Chaturvedi criticised central probe agencies following US charges against Gautam Adani and others in an alleged bribery case linked to solar energy contracts.

Chaturvedi raised concerns about corporate governance and regulatory oversight in the country. “They talk about corporate governance, responsibility, and accountability. The industrialists should be asked to follow the rules and regulations, but even the agencies were defending him. The SEBI has not yet been able to prove charges against him,” she said, pointing to what she viewed as failures in ensuring accountability.

'BROUGHT DISREPUTE TO INDIA'

On US charges against Gautam Adani, AAP leader Sanjay Singh called for a probe against the industrialist. He said that the probe should be conducted by an investigation agency under the Supreme Court.

"Adani Group has brought disrepute to India. This is a very serious matter. The PM of India should come forward and answer this. All the pending matters against Adani should be probed by an investigation agency under Supreme Court monitoring, and all the corruption done by him, within and outside the country, should come out before the country and action should be taken against him," he said.

BJP DFENDS

BJP IT cell chief Amit Malviya responded sharply to the Opposition’s criticism regarding allegations involving Adani Green Energy and US-based Azure Power. He pointed out that the charges in the indictment are only allegations and emphasised, “The defendants are presumed innocent unless and until proven guilty.”

Malviya argued that the crux of the case concerns agreements to supply 12 GW of power to the Solar Energy Corporation of India (SECI), contingent on SECI securing power purchase agreements with state electricity distribution companies (SDCs).
