Panaji, May 21: Former Tehelka editor-in-chief Tarun Tejpal was acquitted by a Goa court on Friday in the 2013 sexual harassment case.

He was accused of forcing himself on the woman, against her wishes, inside an elevator of the Grand Hyatt, Bambolim, Goa on November 7 and 8, 2013, during his newsmagazine Tehelka's official event - the THiNK 13 festival.

The Goa police registered an FIR against Tejpal in November 2013 following which he was arrested. He has been out on bail since May 2014.

Additional Sessions Judge Kshama Joshi reserved her verdict in the seven-year-old case, last month. The trial was held in-camera at Tejpal's instance.

The Goa crime branch had filed a charge sheet against Tejpal. He faced trial under IPC sections 341 (wrongful restraint), 342 (wrongful confinement), 354 (assault or criminal force with intent to outrage modesty), 354-A (sexual harassment), 354-B (assault or use of criminal force to woman with intent to disrobe), 376(2)(f) (person in position of authority over women, committing rape) and 376(2)k) (rape by person in position of control).

Special Public Prosecutor Francisco Tavora assisted by advocate Cyndiana D'Silva represented the Goa Police while Advocates Rajeev Gomes and Amir Khan represented Tejpal.

The Arrest

On November 18, 2013, a few days after the incident, the victim complained to Tehelka's then managing editor, another acclaimed journalist - Shoma Chaudhry. The next day, in a long email, Tejpal sent a formal apology to the victim in which he said, "I apologise unconditionally for the shameful lapse of judgement that led me to attempt a sexual liaison with you on two occasions on November 7 and November 8 2013, despite your clear reluctance that you did not want such attention from me."

He further wrote to Chaudhry, in which he called the incident a bad lapse of judgement, an awful misreading of the situation, have led to an unfortunate incident that rails against all we believe in and fight for.

The victim, however, insisted that an anti-sexual harassment cell be set up under the Vishakha guidelines to investigate the matter.

Given that his apology presents an entirely different version from my testimony, ie. attempts to establish that a "sexual liaison" took place as opposed to him sexually molesting me, I insist once again in the spirit of justice, to constitute an anti-sexual harassment cell in accordance with Vishakha Guidelines.

Tejpal eventually stepped down as editor for six-months to allow a fair internal inquiry.

In the meantime, on November 22, 2013, the Goa Police took suo motu cognisance of the allegations that had become front-page news and registered a complaint. Tejpal alleged he was being framed, and the case was a political conspiracy against him, especially since BJP was the ruling party in Goa.

It may be noted that Tehelka, and with it Tejpal, shot to fame in 2001 with Operation West End, a sting that exposed the then ruling party – NDA led by BJP's - corrupt defence deals, forcing the exit of BJP president, late Bengaru Laxman and defence minister George Fernandes. Tejpal had started the news website along with journalist Anirudhha Bahal.

As for the sexual harassment case, Tejpal was arrested on November 30, 2013, after a local court in Goa rejected his anticipatory bail application. He was granted regular bail by the Supreme Court less than a year later, in July 2014. In February 2014, the Goa Police Crime Branch filed a 2,846-page charge sheet against him.

Three years later, in June 2017, the Sessions Court allowed Tejpal's application to conduct the trial in-camera to protect both the parties' dignity, respect, and privacy.

On September 28, 2017 the Sessions Court framed charges against him, and the victim testified in March 2018. The prosecution has examined 71 witnesses and cross-examined five defence witnesses in the case. The prosecution's case mainly rests on the victim's statement, statements of her colleagues, and electronic evidence in the form of CCTV footage, e-mails and WhatsApp messages.

In August 2019, a Supreme Court bench of Justices Arun Mishra, M R Shah and B R Gavai SC rejected Tejpal's plea to quash the charges against him. Terming the offence "morally abhorrent" and an "assault on the privacy of the victim", the bench directed the Sessions Court to complete the trial within six months.

The prosecution then filed a supplementary charge sheet in January this year, citing ten more witnesses. In March, the prosecution and defence arguments concluded arguments and the case was reserved for orders.

Hamas says the Israeli regime’s sole objective lies in “erasing” the entirety of the Palestinian population from across the Palestinian territories.

Khalil al-Hayya, a ranking official with the Gaza Strip-based Palestinian resistance movement, made the remarks to the Palestinian al-Aqsa TV on Wednesday.

“The occupation targets everyone—it strikes hospitals, civil defense, women, children, and the elderly,” he said, adding that the regime sought to “empty Gaza of its residents, and displace the Palestinian people to fulfill its dreams of building a Zionist Jewish state across all of Palestine.”

The remarks came amid the regime’s October 2023-present war of genocide on the coastal sliver that has so far claimed the lives of nearly 44,000 Palestinians, mostly women and children.

“This unprecedented aggression in modern times evokes scenes from the dark ages of human history, having crossed all red lines and exceeded every expectation of brutality in the modern era,” the Palestinian official lamented.

He also regretted that the regime had added “systematic and dangerous starvation to its aggression, falsely claiming before the world that it allows 250 [aid] trucks into Gaza daily. In reality, the number of trucks is far fewer.”

Hayya, meanwhile, regretted that “scenes of children torn apart, women screaming over their children, and heart-wrenching destruction have failed to stir enough humanity to stop these crimes.”

He decried the United States for vetoing the United Nations Security Council’s resolutions that are aimed at bringing about a potential ceasefire in the war, saying this indicated Washington’s “partnership in the aggression” and a simultaneous siege that the Israeli regime has been enforcing on Gaza.

Addressing Israeli Prime Minister Benjamin Netanyahu, the official asserted that, despite what the Israeli official is after, Hamas would not hand over the regime’s captives “without [the regime’s] stopping the war.”

He called Netanyahu “the main obstacle” in the way of cessation of the aggression, saying the Israeli premier “blocks any progress for political reasons,” and citing his preventing conclusion of a ceasefire agreement in July.

Hayya also warned that the regime sought to expand the war beyond Gaza, but asserted that its goals are “impossible and will never happen.”

“Today, the enemy exposes its true intentions of extermination and displacement, but it will fail,” he stressed.

“The Palestinian people are resilient and will not surrender, as they believe in their humanitarian and political cause. The enemy and its allies will not succeed in achieving their goals. This steadfast people will endure, and the occupation will not prevail against them.”

After the US prosecutors charged Gautam Adani with bribery and fraud, Congress reiterated its call for a Joint Parliamentary Committee (JPC) probe into the transactions of the Adani group, and hit out at Prime Minister Narendra Modi, alleging an "internal nexus" between him and "his favourite businessman."

Senior Congress leader Jairam Ramesh said the indictment of Gautam Adani and others by the US Securities and Exchange Commission validates his party’s call for a Joint Parliamentary Committee investigation.

The Congress has been pushing for the probe since January 2023, raising concerns over alleged irregularities involving Adani and his business dealings, said Ramesh.

Ramesh referred to the party’s “Hum Adani ke Hain” series, where 100 questions were raised about the alleged scams and the links between Prime Minister Narendra Modi and Gautam Adani.
He noted that the questions remain unanswered, reiterating the need for accountability in the matter.

The US prosecutors have charged Adani with deceiving investors by concealing information about his firm's solar energy project in India, which allegedly involved bribery.

Adani has been charged with securities fraud and conspiracy, according to an indictment unsealed on Wednesday. The case focusses on an agreement between Adani Green Energy Ltd. and another organisation to supply 12 gigawatts of solar power to the Indian government.

'BETRAYAL OF INDIAN INVESTORS'

Congress leader Pawan Khera described the allegations against Gautam Adani and his conglomerate as a “betrayal of Indian investors.”

Taking to X, Khera outlined the US charges, including claims that Adani’s group bribed Indian government officials between 2020 and 2024 to secure contracts. Citing media reports, he also pointed out that Gautam Adani personally met a government official to advance the scheme.

Khera referred to a March 2024 incident where the Adani Group allegedly misled the Bombay Stock Exchange and the National Stock Exchange, calling it a “grave violation of investor trust.”

He further highlighted a March 2023 FBI raid on the premises of Sagar Adani, Gautam Adani’s nephew, where electronic devices were seized as part of the investigation.

'SEBI NOT ABLE TO PROVE ANY CHARGES AGAINST ADANI'

Shiv Sena (UBT) leader Priyanka Chaturvedi criticised central probe agencies following US charges against Gautam Adani and others in an alleged bribery case linked to solar energy contracts.

Chaturvedi raised concerns about corporate governance and regulatory oversight in the country. “They talk about corporate governance, responsibility, and accountability. The industrialists should be asked to follow the rules and regulations, but even the agencies were defending him. The SEBI has not yet been able to prove charges against him,” she said, pointing to what she viewed as failures in ensuring accountability.

'BROUGHT DISREPUTE TO INDIA'

On US charges against Gautam Adani, AAP leader Sanjay Singh called for a probe against the industrialist. He said that the probe should be conducted by an investigation agency under the Supreme Court.

"Adani Group has brought disrepute to India. This is a very serious matter. The PM of India should come forward and answer this. All the pending matters against Adani should be probed by an investigation agency under Supreme Court monitoring, and all the corruption done by him, within and outside the country, should come out before the country and action should be taken against him," he said.

BJP DFENDS

BJP IT cell chief Amit Malviya responded sharply to the Opposition’s criticism regarding allegations involving Adani Green Energy and US-based Azure Power. He pointed out that the charges in the indictment are only allegations and emphasised, “The defendants are presumed innocent unless and until proven guilty.”

Malviya argued that the crux of the case concerns agreements to supply 12 GW of power to the Solar Energy Corporation of India (SECI), contingent on SECI securing power purchase agreements with state electricity distribution companies (SDCs).

“I am not addressing him as ‘kaalia’ for the first time. I have not said something highly derogatory. It is being made as big in the backdrop of elections. With love, he used to call me a shorty and I called him a blacky. If I had caused pain to anyone by my words I apologise,” he said.

He further stated: “Kumaraswamy had said that he didn’t want the votes of the Muslim community. But now they are attempting to purchase Muslim votes. Against this backdrop, I have made the remark.”
