UCC against religious freedom; will fight legally, won’t take to streets: Jamiat Ulema-e-Hind

New Delhi, June 19: Prominent Muslim organisation Jamiat Ulema-e-Hind on Monday claimed that the Uniform Civil Code is against the religious freedom guaranteed under the the Constitution but said it will not take to the streets to protest against it and instead would oppose it by taking all possible steps within the ambit of law.

The statement by the Muslim organisation comes days after the Law Commission initiated a fresh consultation process on the Uniform Civil Code (UCC) by seeking views from stakeholders, including public and recognised religious organisations, on the politically sensitive issue.

In a statement, the Jamiat Ulema-e-Hind said it opposes the UCC as it is "totally against the religious freedom and fundamental rights guaranteed to the citizens in Articles 25 and 26 of the Constitution."

"Our Constitution is a secular Constitution, in which every citizen has been given full religious freedom, and every person has been also given the right to choose the religion of his choice, because there is no official religion for the Indian state, and it gives complete freedom to all its citizens," the Jamiat said.

A resolution opposing the UCC was also passed by the executive committee of the Jamiat (Arshad Madani faction) at its executive meeting Sunday.

The demand for a UCC is nothing but a deliberate attempt to curtail the religious freedom of citizens, the Jamiat alleged.

Hence, Jamiat has been opposing this effort from day one as it feels that the demand for a UCC is part of an attempt to destroy the religious freedom of the citizens and the original spirit of the Constitution, the statement said.

The UCC is against the fundamental rights given in the Constitution, it is unacceptable to Muslims, and detrimental to the unity and integrity of the country.

While expressing his views on the resolution passed, Jamiat president Maulana Arshad Madani said this matter pertains not only to Muslims but to all Indians.

Jamiat Ulema-e-Hind cannot compromise on religious affairs and worship in any way, he said.

"We will not protest on the streets but will take all possible steps within the ambit of law (to oppose the UCC)," he said.

In a pluralistic society like India, where followers of different religions have been living in peace and unity following the teachings of their respective religions for centuries, the idea of imposing a UCC is not only surprising but it also seems that Article 44 of the Constitution is being used keeping a particular sect in mind to mislead the majority, the Jamiat said.

"It is being said that this is written in the Constitution, although the second sarsanghchalak (chief) of the RSS Guru Golwalkar, himself said that 'Uniform Civil Code is unnatural to India and against its diversity'. Moreover, while the UCC has been mentioned in the directive principles, the fundamental rights of citizens have been guaranteed in the Constitution," it said.

The Jamiat alleged that the basic rights of the citizens are often being violated and there is no protest about it.

History says that for centuries, people in this country have been following their own religious principles. The religious beliefs and customs of the people have been different, but there has never been any conflict or tension between them, it said.

Jamiat considers religious freedom as being the spirit of the Constitution, whereas Article 44 is an optional matter under Directive Principles of State Policy, the statement said.

Liquor ban in the country also comes under the Directive Principles, it said citing an example.

Neither Parliament nor the Supreme Court has the authority to change the basic provisions listed under Chapter 3 of the Constitution, the Jamiat argued.

In fact, people of a certain mindset are trying to mislead the majority by saying that UCC is part of the Constitution, the Jamiat said.

The minorities, tribes and some other communities of the country have been given freedom under the religious and social law because the identity of different religious communities and groups are associated with their religious and social rituals and customs, and this is also the basis of unity, integrity and unity of the country, the Muslim body asserted.

For centuries, people of different religious groups and communities have been living according to their own personal laws, and in view of this, the Constitution has given citizens religious freedom, it said.

Los Angeles wildfires have continued their trail of devastation, razing death tolls to 24 and destroying thousands of structures, while intensifying winds are worsening the situation for both civilians and firefighters.

In an update on Sunday evening, the County of Los Angeles Department of Medical Examiner said a total of 24 people have died due to the wildfires.

According to the examiner, this number is only an estimate as hundreds of people in various parts of the county are still missing.

Weather forecasters in California are also warning fierce winds which fuelled the infernos around Los Angeles are expected to pick up again this week.

The notoriously dry Santa Ana winds would pick up again from Sunday night until Wednesday, reaching speeds of up to 96km/h, they said.

The most dangerous day will be Tuesday, said weather service meteorologist Rich Thompson. “You are going to have really strong gusty Santa Ana winds, a very dry atmosphere and still very dry brush, so we still have some very critical fire weather conditions out there,” he added.

On Saturday, the flames spread east, creeping closer to Interstate 405 and a busy mountain pass. This is a “significant development,” said L.A. County spokesman Jesus Ruiz.

With the fire rapidly growing and moving in the direction of “a heavily populated area … we are definitely concerned,” he continued.

Gavin Newsom, governor of California said that he believes that in terms of costs associated with the wildfire, it will be the worst natural disaster in terms scale and scope in the history of the US, and the fatalities is likely to increase significantly as well.

On Sunday, private forecaster Accuweather increased its preliminary estimate of financial losses from the blazes to between $250 billion to $275 billion. The wildfires are on track to be among the costliest in US history.

Incoming American President-elect Donald Trump says the raging wildfires in Los Angeles have caused more destruction than a nuclear impact, warning that the real number of fatalities in the affected areas is likely to far surpass the current death toll.

In an interview with American cable news Newsmax on Monday, he solemnly forecast a sharp rise in the death toll from the devastating Los Angeles wildfires as local authorities deploy cadaver-sniffing dogs to comb through the rubble.

“I believe it’s greater damage than if they got hit by a nuclear weapon. I’ve never seen anything like it. Vast miles and miles of houses just burned to a crisp. There’s nothing standing,” Trump told the outlet.

The colossal wildfires, which started last week, were fueled by hurricane-force winds carrying dry desert air. Since then, at least 24 people have lost their lives, according to the Los Angeles County Medical Examiner.

However, Trump emphasized that the two dozen confirmed deaths are likely to be overshadowed by the actual toll.

“They’re going to find many bodies, you know. Only the dogs will find them, right? You know, German Shepherds will. They can pick out the ashes immediately. It’s amazing. But we’re gonna find many bodies and many more, many more dead,” the incoming president added, as he was blown away by images of the sheer level of destruction caused by the devouring fires.

The wildfires have already burned over 40,000 acres and obliterated more than 12,000 structures, wiping out entire neighborhoods.

“We’re gonna do things with Los Angeles. You know, I’m already putting my developer cap on because it looks literally– I just saw some very guarded pictures of it. And it’s far worse than you even see on television, if that’s believable,” Trump further said.

As expected, the incoming president already blamed the Democrat leadership for the wildfires, particularly slamming California Governor Gavin Newsom for mismanagement of the “apocalyptic” wildfires.

“Governor Gavin Newscum refused to sign the water restoration declaration put before him that would have allowed millions of gallons of water, from excess rain and snow melt from the North, to flow daily into many parts of California, including the areas that are currently burning in a virtually apocalyptic way,” Trump said on January 8.

As of Monday, over 92,000 people in Los Angeles County were under evacuation orders, a decrease from the previous peak of more than 150,000, while an additional 89,000 were facing evacuation warnings.

In a no-holds-barred attack on RSS chief Mohan Bhagwat for his remark that India got "true independence" after the Ram Temple in Ayodhya was consecrated, Congress leader Rahul Gandhi today said the comment amounted to "treason" and that Mr Bhagwat would be arrested and tried if he was in any other country.

Mr Gandhi was addressing an event to mark the inauguration of the new Congress headquarters in Delhi. "We are getting a new headquarters at a very particular time. I think it's quite symbolic that yesterday, the chief of the RSS said that India never achieved Independence in 1947. He said true Independence in India was achieved when the Ram Mandir was built. He says that the Constitution was not the symbol of our freedom."

"Mohan Bhagwat has the audacity to inform the nation every two or three days what he thinks about the Independence movement, what he thinks about the Constitution. What he has said yesterday is treason because it is stating that the Constitution is invalid, it is stating that everything (done) to fight against the British was invalid and he has the audacity to say this publicly," Mr Gandhi said, adding, "in any other country, he would be arrested and tried".

"To say that India did not get Independence in 1947 is an insult to every single Indian and it's about time we stop listening to this nonsense that these people think they can just keep parroting out and shouting and screaming," the Leader of the Opposition in Lok Sabha said.

Mr Bhagwat was in Indore on Monday to present the National Devi Ahilya award to Champat Rai, general secretary of Shri Ram Janmabhoomi Teerth Kshetra Trust. Addressing a gathering there, he said the day of the consecration of Ram Temple in Ayodhya should be celebrated as "Pratishtha Dwadashi" as it marks the "true independence" of Bharat. 

"India, which faced enemy attacks for centuries, witnessed its true independence that day. We had independence, but it had not been established. India got political independence on August 15, 1947, we also brought a Constitution but the country did not run in its spirit. How can we accept that dreams have been fulfilled and pain alleviated? Our swa (self) is Ram, Krishna and Shiva. Do they belong only to those who worship them? No. Ram connects people from north to south, Krishna from east to west and Shiva is in every particle of Bharat," he said.
