UCC will destabilize India, demolish diversity and create chaos in society: Moily warns Modi

New Delhi, July 5: Amid the raging debate over the Uniform Civil Code, senior Congress leader and former law minister M Veerappa Moily on Wednesday urged Prime Minister Narendra Modi, the Law Commission and all political leaders not to open the "Pandora's box" on personal laws and "create chaos" in the society.

He also alleged that it was an issue that was intended to divide the society, destabilise the country and demolish the diversity enjoyed in Indian society.

In a statement, Moily underlined that Article 25 provides for the Right to Freedom of Religion.

"Prime Minister Narendra Modi has recently given a public thrust to Uniform Civil Code (UCC). Even though the Constitution of India makes a mention of the UCC, the founding fathers of the Constitution in the Constituent Assembly had chosen not to make it mandatory, as it involves the diversity of Indian society," said Moily, who was the law minister in the UPA-II government from May 2009 to May 2011.

Uniformity or commonality of the civil code for all regions and cultures of India is a different matter, he argued. 

"It would entail breaking the promise made to Nagas and Mizos to not interfere in their customs and could feed secessionist sentiments that are active to varying degrees in the region," Moily said.

He added that this will have repercussions not only for minorities such as Muslims, Christians, it will also have substantial effect on Sikhs, Jains, Buddhist and hundreds of tribes and among various sects in Hindus such as Aliyasantana in Dakshina Kannada in Karnataka and Marumakkathayam in Kerala.

"As expected, UCC is envisaged as a Muslim issue, forgetting other diversities prevailing in the country," he alleged.

Moily noted that the 21st Law Commission of India had declared that the UCC is neither necessary nor desirable.

He said that the Constitution bench of the Supreme Court had already framed seven questions of law linked to religious freedom, rights and practices in the Sabarimala case. 

The first of the seven questions is what is the scope and ambit of Right to Freedom of Religion under Article 25 of the Constitution, he pointed out and noted that the said reference is still pending in the Supreme Court.

The 22nd Law Commission of India has rushed to issue a public notice for a fresh debate on the Uniform Civil Code, he said.

"The statement of the prime minister at the most may be a platitude in the meeting of the BJP party and may be a part of the BJP manifesto for the forthcoming Lok Sabha election of 2024," Moily said.

Neither any state nor the next Parliament can rush to the UCC legislation in the absence of a full-fledged report of the 22nd Law Commission or the judgment of the Supreme Court which had framed seven questions of law, he asserted.

The right to preserve one's religious identities through personal laws cannot be annulled by a premature proclamation of the prime minister, the senior Congress leader said.

He said that it should not be forgotten that the report of the 21st Law Commission of India will have to be debated and the Supreme Court should also come out with its verdict. 

"All the debates which are taking place now are premature, short-sighted and tend to create hatred in the society. Such debates are also intended to sabotage the concept of secularism which has always been upheld by the founding fathers of the Constitution," Moily said.

"I appeal to the prime minister of India, the Law Commission and all the political leaders not to open up the Pandora's box on personal laws and create chaos in the society which is intended to divide the society and destabilise the country and to demolish the diversity enjoyed in the Indian society," he said.

UCC refers to a common set of laws that are applicable to all the citizens of India that is not based on religion and dealing with marriage, divorce, inheritance and adoption among other matters.

The Law Commission had on June 14 initiated a fresh consultation process on UCC by seeking views from stakeholders, including public and recognised religious organisations, on the politically sensitive issue.

Addressing a gathering of party workers in Bhopal last week, Prime Minister Modi had made a strong pitch for the UCC, saying that the Constitution calls for equal rights for all citizens.

Modi had also said the opposition is using the issue of UCC to mislead and provoke the Muslim community.

An Israeli airstrike on the office of Syria’s Baath party in Lebanon’s capital Beirut has killed the Lebanese resistance movement Hezbollah's Media Relations Officer, Mohammad Afif, reports say.

Lebanon's National News Agency (NNA) reported that the Israeli raid struck the Ba'ath party’s building in central Beirut district of Ras Al-Naba'a on Sunday, adding that the strike was an attempt to assassinate the leader of the resistance media front.

According to Baath Secretary-General Ali Hijazi, Afif was having a meeting in the Baath Party headquarters when Israel carried out the attack.

"Afif did not fight with weapons and did not lead a military unit in Hezbollah. Rather, he led a media unit," he said.

Reuters, Sky News, Al Jazeera and a number of Henrew-language media reported that Afif was killed in the Israeli strike.

However, Hezbollah has not yet confirmed Afif’s death or whether he was present at the site or not.

Earlier, the Lebanese Health Ministry said at least one person was killed and three others injured after an Israeli strike targeted a central district in Beirut.

Lebanon's al-Mayadeen television network reported that five people were killed in the attack.

The latest development came after Afif said Hezbollah was behind the Caesarea operation and targeting Netanyahu’s home during a speech at the Ghobeiry area in the southern suburbs of Beirut on October 22.

This was the second assassination attempt on Afif in the last two months, after he survived an attack on the Hezbollah media relations office several weeks ago.

Israel launched a ground assault and massive air campaign against Lebanon in late September after a year of exchanging fire across the Lebanese border in parallel with the Gaza war.

At least 3,287 people have been killed in Israeli strikes in Lebanon over the past year, with the vast majority in the past seven weeks. Another 14,222 have been wounded, mostly women and children.

In response to the ongoing aggression, the Lebanese resistance movement Hezbollah has been staging hundreds of retaliatory strikes against the occupied Palestinian territories and the Israeli forces trying to advance on southern Lebanese areas.

The movement has vowed to sustain its strikes until the regime ends the escalation.

Mysuru, Nov 12: Zameer Ahmad Khan, the Tourism and Waqf minister of Karnataka, who stirred a controversy by addressing the Union Minister HD Kumaraswamy as ‘Kaala Kumaraswamy’ has tendered apologies for his remarks.

Speaking to reporters in Mysuru on Tuesday, Minister Zameer stated that he will apologise if remarks have hurt JD-S workers.

“We both are very close. Then, in a total of 24 hours, we were together for 14 hours. He used to fondly address me as “kulla” (shorty) and I used to address him as “kariyanna” (blacky, kaalia),” Minister Zameer stated.

“I am not addressing him as ‘kaalia’ for the first time. I have not said something highly derogatory. It is being made as big in the backdrop of elections. With love, he used to call me a shorty and I called him a blacky. If I had caused pain to anyone by my words I apologise,” he said.

He further stated: “Kumaraswamy had said that he didn’t want the votes of the Muslim community. But now they are attempting to purchase Muslim votes. Against this backdrop, I have made the remark.”

Minister for Home G. Parameshwara stated on Tuesday, “Minister Zameer and Kumaraswamy are close friends. Their comments against each other are not significant.”

Zameer Ahmad Khan, the Tourism and Waqf minister of Karnataka stirred a controversy on Monday as he addressed the Union Minister as ‘Kaala Kumaraswamy’.

JD-S on Tuesday demanded a public apology and resignation of Minister for Waqf and Tourism Zameer Ahmad Khan over his ‘racist’ remarks.

“Remember, there is no place here for your divisive policies. You have insulted the people by making ethnic, racist and discriminatory statements. You should apologize to the people of the state and resign,” the JD (S) demanded in the post.

Union Parliamentary Affairs and Minister for Minority Affairs Kiren Rijiju reacted sternly to the racist jibe and stated, “I strongly deplore Congress Minister Zameer Ahmed calling Union Minister and former Chief Minister of Karnataka Kumaraswamy as 'Kaalia Kumaraswamy'.

In the wake of the tragic drowning of three students at a resort near Ullal on the outskirts of Mangaluru city, the tourism department in Dakshina Kannada is set to implement comprehensive safety guidelines for properties with swimming pools or beach access. This initiative aims to ensure guest safety and prevent similar incidents in the future.

New Safety Mandates for Resorts and Homestays

Rashmi S.R., deputy director (in-charge) of the tourism department, announced, “We will instruct all homestays and resorts to enforce precautionary measures, especially those with pools or direct beach access. Properties must ensure 24/7 supervision, particularly during guest hours. This tragedy highlights the importance of having trained personnel on-site.”

Key Safety Guidelines

The district, home to around 150 homestays and 130 resorts, will see the following measures enforced:

  • Clearly displaying pool depths.
  • Installing adequate safety equipment, such as life buoys.
  • Employing trained lifeguards at all times.
  • Establishing clear pool operating hours.
  • Reviewing and implementing standard operating procedures (SOPs) for pool and beach usage.

Booming Beach Tourism Calls for Vigilance

Manohar Shetty, president of the Association for Coastal Tourism (ACT), Udupi, highlighted the growing popularity of beachside resorts, particularly during peak seasons. Properties in Udupi, often fully booked with tourists from Bengaluru, Mysuru, Kodagu, and Shivamogga, face increasing pressure to maintain safety standards.

Udupi district boasts 22 beachside commercial properties catering to this rising demand.

Shetty emphasized, “Authorities must scrutinize safety measures and carefully evaluate guidelines before issuing new resort licenses. Panchayats should rely on the Karnataka Town and Country Planning Act when handling such cases.”

Long-Term Solutions for Water Safety

Recognizing the need for a cultural shift in water safety, Shetty proposed integrating swimming lessons into school curricula. This move would not only equip students with essential skills but also encourage safe participation in water-based activities.
