Like volcano, communal violence scars the ground it touches: Kapil Sibal arguing for Zakia Jafri

New Delhi, Nov 10: Communal violence is like a lava erupting from a volcano which scars the ground it touches, senior advocate Kapil Sibal told the Supreme Court on Wednesday while arguing for Zakia Jafri who has challenged the SIT’s clean chit to 64 persons including Narendra Modi, the then Gujarat chief minister during the 2002 riots there.

Sibal told a bench headed by Justice A M Khanwilkar that communal violence is a “fertile ground” for future revenge and he too had lost his maternal grandparents in Pakistan.

“Communal violence is like lava erupting from a volcano. It is institutionalized violence. Wherever that lava touches, it scars the earth. It is a fertile ground for future revenge,” he told the bench, also comprising Justices Dinesh Maheshwari and C T Ravikumar.

“I lost my maternal grandparents to it in Pakistan,” a visibly emotional Sibal told the bench, which was hearing Jafri’s plea.

The senior advocate, who was representing Jafri, said he is not accusing A or B but a message must be sent to the world that this is “unacceptable” and “cannot be tolerated”. He said this is a “historic matter” because the choice is between ensuring that rule of law will prevail or letting people run amok.

The argument in the matter is going on in the apex court.

Jafri is the wife of slain Congress leader Ehsan Jafri, who was killed at Gulberg society in Ahmedabad on February 28, 2002 during the violence.

Ehsan Jafri, the former MP, was among the 68 people killed in the violence, a day after the S-6 Coach of the Sabarmati Express was burnt at Godhra killing 59 people and triggering riots in Gujarat.

On October 26, the apex court had said it would like to peruse the closure report of the Special Investigation Team (SIT) giving the clean chit to 64 persons and the justification given by the magisterial court while accepting it.

Sibal had earlier argued that Jafri’s complaint was that there was “a larger conspiracy where there was bureaucratic inaction, police complicity, hate speeches and unleashing of violence”.

On February 8, 2012, the SIT had filed a closure report giving a clean chit to Modi, now the prime minister, and 63 others, including senior government officials, saying there was “no prosecutable evidence” against them.

Zakia Jafri had filed a petition in the apex court in 2018 challenging the Gujarat High Court’s October 5, 2017 order rejecting her plea against the decision of the SIT.

The plea also maintained that after the SIT gave a clean chit in its closure report before a trial judge, Zakia Jafri filed a protest petition which was dismissed by the magistrate without considering “substantiated merits”. It also said the high court “failed to appreciate” the petitioner’s complaint which was independent of the Gulberg Society case registered at a Police Station in Ahmedabad.

The high court in its October 2017 order had said the SIT probe was monitored by the Supreme Court. However, it partly allowed Zakia Jafri’s petition as far as its demand for a further investigation was concerned.

It had said the petitioner can approach an appropriate forum, including the magistrate’s court, a division bench of the high court, or the Supreme Court seeking further investigation.

Udupi, Nov 11: A traveller reportedly lost ₹4.1 lakh after attempting to book a cab online in Udupi. 

At around 1:30 PM on November 7, the man from West Bengal searched for car rentals on Google and selected a website named "Shakti Car Rentals." Shortly after, he was contacted by someone claiming to be "Rohit Sharma," who directed him to pay a registration fee of ₹150 on the site.

After unsuccessful payment attempts via both his Canara Bank debit card and SBI credit card (without receiving an OTP), "Rohit Sharma" instructed him to pay the driver directly. But at 1:47 PM, he received messages showing deductions of ₹3.3 lakh from his SBI credit card and ₹80,056 from his Canara Bank debit card, totaling ₹4.1 lakh.

The complainant alleges fraud through a deceptive link disguised as a booking token fee. A case has been registered at Udupi Town Police Station.

An Israeli airstrike on the office of Syria’s Baath party in Lebanon’s capital Beirut has killed the Lebanese resistance movement Hezbollah's Media Relations Officer, Mohammad Afif, reports say.

Lebanon's National News Agency (NNA) reported that the Israeli raid struck the Ba'ath party’s building in central Beirut district of Ras Al-Naba'a on Sunday, adding that the strike was an attempt to assassinate the leader of the resistance media front.

According to Baath Secretary-General Ali Hijazi, Afif was having a meeting in the Baath Party headquarters when Israel carried out the attack.

"Afif did not fight with weapons and did not lead a military unit in Hezbollah. Rather, he led a media unit," he said.

Reuters, Sky News, Al Jazeera and a number of Henrew-language media reported that Afif was killed in the Israeli strike.

However, Hezbollah has not yet confirmed Afif’s death or whether he was present at the site or not.

Earlier, the Lebanese Health Ministry said at least one person was killed and three others injured after an Israeli strike targeted a central district in Beirut.

Lebanon's al-Mayadeen television network reported that five people were killed in the attack.

The latest development came after Afif said Hezbollah was behind the Caesarea operation and targeting Netanyahu’s home during a speech at the Ghobeiry area in the southern suburbs of Beirut on October 22.

This was the second assassination attempt on Afif in the last two months, after he survived an attack on the Hezbollah media relations office several weeks ago.

Israel launched a ground assault and massive air campaign against Lebanon in late September after a year of exchanging fire across the Lebanese border in parallel with the Gaza war.

At least 3,287 people have been killed in Israeli strikes in Lebanon over the past year, with the vast majority in the past seven weeks. Another 14,222 have been wounded, mostly women and children.

In response to the ongoing aggression, the Lebanese resistance movement Hezbollah has been staging hundreds of retaliatory strikes against the occupied Palestinian territories and the Israeli forces trying to advance on southern Lebanese areas.

The movement has vowed to sustain its strikes until the regime ends the escalation.

Bengaluru: Karnataka Chief Minister Siddaramaiah has instructed the Hindu Religious Endowment Department to submit a proposal for constructing a gold chariot for the presiding deity of the state, Chamundeshwari, official sources said on Monday.

The directive follows a request from Member of Legislative Council (MLC) Dinesh Gooligowda, who highlighted the historical and cultural significance of the Chamundeshwari Temple on Chamundi Hill in Mysuru, which dates back to the 12th century AD.

Gooligowda noted that the existing wooden chariot, donated by devotees from Coimbatore, Tamil Nadu, has deteriorated over time.

“Devotees have expressed their desire to organise a ‘rathotsava’ using a gold chariot for Goddess Chamundeshwari. This proposal has been under consideration for some time, with an estimated cost of Rs 100 crore,” the MLC said.

He emphasised that the government’s financial involvement would not be required, as devotees are willing to contribute towards making the chariot a reality.

Gooligowda proposed a deadline for the 2025 Dasara festival for the completion of the chariot, ensuring it is ready for the grand procession featuring the idol of Chamundeshwari.
