Johnson & Johnson ordered to pay $417m to woman for “causing cancer”

Los Angeles, Aug 23: A jury in United States has ordered Johnson & Johnson to pay a record $417 million to a hospitalised woman who claimed in a lawsuit that the talc in the company’s iconic baby powder causes ovarian cancer when applied regularly for feminine hygiene.

The verdict in the lawsuit brought by the California woman, Eva Echeverria, marks the largest sum awarded in a series of talcum powder lawsuit verdicts against Johnson & Johnson in courts around the US.

Echeverria alleged Johnson & Johnson failed to adequately warn consumers about talcum powder’s potential cancer risks. She used the company’s baby powder on a daily basis beginning in the 1950s until 2016 and was diagnosed with ovarian cancer in 2007, according to court papers.

Echeverria developed ovarian cancer as a “proximate result of the unreasonably dangerous and defective nature of talcum powder,” she said in her lawsuit.

Echeverria’s attorney, Mark Robinson, said his client is undergoing cancer treatment while hospitalised and told him she hoped the verdict would lead Johnson & Johnson to put additional warnings on its products.

“Mrs. Echeverria is dying from this ovarian cancer and she said to me all she wanted to do was to help the other women throughout the whole country who have ovarian cancer for using Johnson & Johnson for 20 and 30 years,” Robinson said.

“She really didn’t want sympathy,” he added. “She just wanted to get a message out to help these other women.”

The jury’s award included $68 million in compensatory damages and $340 million in punitive damages, Robinson said. The evidence in the case included internal documents from several decades that “showed the jury that Johnson & Johnson knew about the risks of talc and ovarian cancer,” Robinson said.

“Johnson & Johnson had many warning bells over a 30 year period but failed to warn the women who were buying its product,” he said.

Johnson & Johnson spokeswoman Carol Goodrich said in a statement that the company will appeal the jury’s decision. She says while the company sympathises with women suffering from ovarian cancer that scientific evidence supports the safety of Johnson’s baby powder.

The verdict came after a St. Louis, Missouri jury in May awarded $110.5 million to a Virginia woman who was diagnosed with ovarian cancer in 2012.

She had blamed her illness on her use of the company’s talcum powder-containing products for more than 40 years.

Besides that case, three other trials in St. Louis had similar outcomes last year — with juries awarding damages of $72 million, $70.1 million and $55 million, for a combined total of $307.6 million.

Another St. Louis jury in March rejected the claims of a Tennessee woman with ovarian and uterine cancer who blamed talcum powder for her cancers.

Two similar cases in New Jersey were thrown out by a judge who said the plaintiffs’ lawyers did not presented reliable evidence linking talc to ovarian cancer.

More than 1,000 other people have filed similar lawsuits. Some who won their lawsuits won much lower amounts, illustrating how juries have wide latitude in awarding monetary damages.

Johnson & Johnson is preparing to defend itself and its baby powder at upcoming trials in the US, Goodrich said.

Mysuru, Nov 12: Zameer Ahmad Khan, the Tourism and Waqf minister of Karnataka, who stirred a controversy by addressing the Union Minister HD Kumaraswamy as ‘Kaala Kumaraswamy’ has tendered apologies for his remarks.

Speaking to reporters in Mysuru on Tuesday, Minister Zameer stated that he will apologise if remarks have hurt JD-S workers.

“We both are very close. Then, in a total of 24 hours, we were together for 14 hours. He used to fondly address me as “kulla” (shorty) and I used to address him as “kariyanna” (blacky, kaalia),” Minister Zameer stated.

“I am not addressing him as ‘kaalia’ for the first time. I have not said something highly derogatory. It is being made as big in the backdrop of elections. With love, he used to call me a shorty and I called him a blacky. If I had caused pain to anyone by my words I apologise,” he said.

He further stated: “Kumaraswamy had said that he didn’t want the votes of the Muslim community. But now they are attempting to purchase Muslim votes. Against this backdrop, I have made the remark.”

Minister for Home G. Parameshwara stated on Tuesday, “Minister Zameer and Kumaraswamy are close friends. Their comments against each other are not significant.”

Zameer Ahmad Khan, the Tourism and Waqf minister of Karnataka stirred a controversy on Monday as he addressed the Union Minister as ‘Kaala Kumaraswamy’.

JD-S on Tuesday demanded a public apology and resignation of Minister for Waqf and Tourism Zameer Ahmad Khan over his ‘racist’ remarks.

“Remember, there is no place here for your divisive policies. You have insulted the people by making ethnic, racist and discriminatory statements. You should apologize to the people of the state and resign,” the JD (S) demanded in the post.

Union Parliamentary Affairs and Minister for Minority Affairs Kiren Rijiju reacted sternly to the racist jibe and stated, “I strongly deplore Congress Minister Zameer Ahmed calling Union Minister and former Chief Minister of Karnataka Kumaraswamy as 'Kaalia Kumaraswamy'.

In the wake of the tragic drowning of three students at a resort near Ullal on the outskirts of Mangaluru city, the tourism department in Dakshina Kannada is set to implement comprehensive safety guidelines for properties with swimming pools or beach access. This initiative aims to ensure guest safety and prevent similar incidents in the future.

New Safety Mandates for Resorts and Homestays

Rashmi S.R., deputy director (in-charge) of the tourism department, announced, “We will instruct all homestays and resorts to enforce precautionary measures, especially those with pools or direct beach access. Properties must ensure 24/7 supervision, particularly during guest hours. This tragedy highlights the importance of having trained personnel on-site.”

Key Safety Guidelines

The district, home to around 150 homestays and 130 resorts, will see the following measures enforced:

  • Clearly displaying pool depths.
  • Installing adequate safety equipment, such as life buoys.
  • Employing trained lifeguards at all times.
  • Establishing clear pool operating hours.
  • Reviewing and implementing standard operating procedures (SOPs) for pool and beach usage.

Booming Beach Tourism Calls for Vigilance

Manohar Shetty, president of the Association for Coastal Tourism (ACT), Udupi, highlighted the growing popularity of beachside resorts, particularly during peak seasons. Properties in Udupi, often fully booked with tourists from Bengaluru, Mysuru, Kodagu, and Shivamogga, face increasing pressure to maintain safety standards.

Udupi district boasts 22 beachside commercial properties catering to this rising demand.

Shetty emphasized, “Authorities must scrutinize safety measures and carefully evaluate guidelines before issuing new resort licenses. Panchayats should rely on the Karnataka Town and Country Planning Act when handling such cases.”

Recognizing the need for a cultural shift in water safety, Shetty proposed integrating swimming lessons into school curricula. This move would not only equip students with essential skills but also encourage safe participation in water-based activities.

Mangaluru: A tragic incident unfolded on Sunday, November 17, at Vazco Resort (VAZCO), situated at Battappadi Cross Road in Someshwara on the outskirts of the city, when three young women drowned in the resort’s swimming pool. 

Disturbingly, an iPhone recording and CCTV footage captured their final moments, providing insights into the heartbreaking accident.

According to City Police Commissioner Anupam Agrawal, the tragedy occurred at approximately 10:05 AM. The victims were identified as:

Keerthana N (21) from Devaraj Mohalla, Hebbal Second Stage, Vijayanagar Post.
Nishitha M.D (21) from 4th Cross, Kuribarahalli, Mysuru.
Parvathi S (20) from Ramanuja Road, K.R. Mohalla, Mysuru.

Sequence of Events

The three women had checked into Room No. 2 of the resort on the morning of November 16 and stayed overnight. On Sunday morning, around 10 AM, they entered the swimming pool to play. Reports suggest that they placed their clothes poolside and set an iPhone to record the activity.

Initial findings indicate one woman slipped underwater and began to struggle. When the second attempted a rescue, she too drowned, followed by the third woman. Within minutes, the tragedy claimed all three lives. CCTV footage from the resort corroborates the sequence, showing the young women struggling before succumbing to the water.

Investigation Underway

The resort staff discovered the lifeless bodies and immediately raised the alarm. Ullal Police Inspector H N Balakrishna and his team are conducting an investigation. Preliminary reports suggest the women were non-swimmers, and the lack of safety measures contributed to the tragedy.

The resort is owned by Manohar, as per police records. While the formal case is yet to be registered, the incident has raised serious questions about safety protocols at resorts offering pool facilities.
