Mangaluru, Jul 29: Seven years after he raped a woman near Kadaba in Puttur taluk after promising to marry her, a labourer has been awarded five years of rigorous imprisonment, by a local court.
Out of the Rs 10,000 fine amount, the judge directed that Rs 8,000 be paid to the victim, then 24 years. In case, Sundara fails to pay the fine, the court directed that he undergo an additional three months simple imprisonment. On charges of cheating (section 417 IPC), judge directed Sundara to undergo three months simple imprisonment.
In addition, the judge also directed the District Legal Aid Services Authority to compensate the victim under Karnataka Victim Compensation Scheme.
The incident reported at Kadaba police station on November 7, 2009, saw then 24-year-old woman accuse 31-year-old Sundara of raping her after promising to marry her.
The Kadaba police arrested Sundara and filed charge sheet before JMFC Court, Puttur, charging Sundara under section 417 (cheating) of IPC.
The JMFC court who recorded evidence of the victim, invoked section 376 of IPC as well and promptly referred the case for trial by the sessions' court.
Pre-Nirbhaya case
Public prosecutor Judith O M Crasta said since this was a pre-Nirbhaya case, the court used its discretionary powers in slapping a five-year prison term on the sexual offender. Post Nirbhaya case and the amendments that followed, a person convicted of sexual assault will have to serve minimum prison term of seven years, she said.
