Karnataka High Court upholds hijab ban, claims headscarf not an essential religious practice

Bengaluru, Mar 15: In a major blow to Muslims in Karnataka, the High Court has upheld the ban on hijab imposed by the BJP government in educational institutions.

Even though holy Quran has ruled that covering head is mandatory for all Muslim women, the High Court went on to claim that wearing of Hijab does not form part of essential religious practice of Islamic faith.

Pronouncing its judgment in a batch of petitions over hijab controversy, a three-judge full bench of the court also held that prescription of school uniform is only a reasonable restriction constitutionally permissible which the students cannot object to. 

Insofar as the challenge to the Government Order dated February 5, 2022, the court said that the state government has power to issue order and no case is made out for its invalidation.

A three-judge bench comprising Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit and Justice J M Khazi said that it had formulated a few questions and answered them.

The four questions that were formulated were:
1)    whether wearing hijab is a part of essential religious practice in Islamic faith protected under Article 25 of the Constitution,
2)     whether prescription of school uniform is not legally permissible as being violative of Article 19 (1) (a) and Article 21 of the constitution, 
3)    whether the Government Order dated February 5, 2022 apart from being incompetent is issued without application of mind arbitrary and hence violates Article 14 and 15 of the constitution,
4)     and finally whether disciplinary action should be taken against the school staff at Udupi Girls PU College.

“We are of the considered opinion that wearing of hijab by Muslim women does not form a part of essential religious practice in Islamic faith. The answer to second question is, we are of the considered opinion that the prescription of school uniform is only reasonable restriction constitutionally permissible which the students cannot object to. The answer to third question is, in view of above we are of the considered opinion that the government has power to issue the impugned government order dated 5-02-2022 and no case is made out for its invalidation. The answer to fourth question is, we are of the considered opinion that no case is made out in WP 2146/2022 for issuance of a direction for initiating disciplinary enquiry against respondents is rejected being not maintainable,” the bench said.

The bench further said, “Accordingly in the above circumstances, all these writ petitions being devoid of merits are liable to be and liable to be dismissed.” 

After the verdict, CM Basavaraj Bommai urged students to adhere to the Karnataka High Court order. "I request students to give priority to their studies. Come to school, study and attend exams," he said.

Mangaluru: Establishing a Beary Development Corporation is a valid demand, but its implications must be carefully studied, remarked Speaker UT Khader. He proposed forming an expert committee to evaluate the corporation’s potential impact on the Beary community during a district-level conference of the Beary-speaking community, organized by the Akhila Bharata Beary Mahasabha at Kudmul Ranga Rao Town Hall on Wednesday.

Khader expressed concerns over inefficiencies in existing government-established corporations, such as unfilled leadership positions, lack of appointed members, and insufficient funding. “The Beary Development Corporation must avoid similar pitfalls,” he emphasized. He noted that the Minorities Development Corporation already provides various schemes for Beary Muslims, urging a detailed assessment to ensure the new corporation’s funding does not fall short of current provisions, which could disadvantage the community.

Praising the industrious and self-respecting nature of the Beary community, Khader highlighted the respect Beary elders once commanded in villages. He encouraged the youth to uphold this legacy and actively contribute to the community’s progress. Additionally, he commended the Beary youth for their swift and dedicated responses during emergencies, which have garnered widespread recognition.

Khader underscored the importance of unity, cautioning against fostering divisions within the community. He also stressed the critical role of education in development, urging the maintenance of detailed records for SSLC and PUC students to track progress.

The event was presided over by Azeez Baikampadi, president of the Akhila Bharata Beary Mahasabha. Among the dignitaries present were former MLA Mohiudeen Bava and retired police officer GA Bawa. Dr. UT Ifikhar Ali Farid, honorary president of the Akhila Bharata Beary Mahasabha and chairman of the Karnataka State Allied and Healthcare Council, was felicitated during the program.

In notable initiatives, Kanachuru Monu, chairman of Kanachuru Medical College, unveiled the Mahasabha’s new website, while Sheikhabba Karnire of Expertise Company, Jubail, launched an IAS-IPS program aimed at empowering the Beary community.

The United Nations Children’s Fund (UNICEF) has reported that at least 74 children were killed in Israel’s relentless violence in the Gaza Strip during the first week of 2025, marking a grim start to the New Year for children in the besieged territory.

In a recent report released on Wednesday, UNICEF said that the fatalities occurred within just eight days, emphasizing that the lack of adequate shelter, compounded by winter weather, poses severe risks to the children in Gaza.

“For the children of Gaza, the New Year has brought more death & suffering with at least 74 children reportedly killed,” Executive Director of UNICEF Catherine Russell said, calling for an immediate ceasefire to end the violence.

She expressed deep concern over the number of children who have either been killed or have lost loved ones during the tragic beginning of the year.

Numerous fatalities have occurred during mass casualty events, including nighttime assaults in Gaza City, Khan Yunis, and al-Mawasi, which has been designated a "safe zone." The most recent attack claimed the lives of five children in al-Mawasi on Tuesday, according to UNICEF.

The situation is dire, with reports indicating that eight infants and newborns have died from hypothermia since December 26, highlighting the severe risk facing young children who are unable to regulate their body temperature amid the harsh conditions as Israel weaponizes cold against children in the Gaza strip.

“UNICEF has long warned that inadequate shelter, lack of access to nutrition and healthcare, the dire sanitary situation, and now the winter weather put the lives of all children in Gaza at risk. Newborns and children with medical conditions are especially vulnerable,” Russell emphasized.

The humanitarian crisis in Gaza has reached alarming levels. The number of aid trucks entering the region remains grossly inadequate to meet the basic needs of families, while civil order has largely unraveled, leading to the looting of humanitarian supplies.

According to UN reports, over a million children are currently living in makeshift tents, with almost all of the 2.3 million population displaced several times over the last 15 months.

Moreover, the few operational hospitals are overwhelmed, and the destruction of civilian infrastructure has severely hampered access to essential services, including food, clean water, sanitation, and healthcare.

Kamal Adwan Hospital, previously the only functioning medical facility in northern Gaza with a pediatric unit, has ceased operations following a raid last month, exacerbating the already critical healthcare situation.

A recent report from the Palestinian Central Bureau of Statistics noted a 6% decline in Gaza's population in 2024, indicating that Israeli forces are intentionally targeting specific demographic groups, such as children and youth, resulting in a significant “distortion of the population.”

Since the onset of the genocide, Israel has killed 45,936 Palestinians, including over 17,600 children, as reported by the Health Ministry in Gaza, indicating a tragic loss of one child approximately every hour.

Eight members of the Israeli Knesset (parliament) have called upon the regime’s minister of military affairs Israel Katz to instruct the occupation army to destroy all water, food and energy sources in the Gaza Strip “to achieve the war goals.”

The letter to Katz asserted “the Israeli military’s operations were failing to achieve the political objectives set for the war”, the Israeli Haaretz daily newspaper reported. 

Despite Israel’s complete siege on the Gaza Strip and the reduction in aid being allowed into the coastal territory, the legislators said the current plans to displace north Gaza residents to the south are not being implemented “properly”.

The Knesset members urged Katz to re-examine war strategies, asserting that after besieging northern Gaza and displacing its residents, the Israeli military should destroy all energy, food and water sources in the area.

They also called for the killing of anyone who moved within northern Gaza without surrendering by waving a white flag.

The measures should not be limited to northern Gaza, they said, but extended to other regions.

They made no mention of the Israeli captives being held in Gaza, Haaretz noted.

Backed by the United States and its Western allies, Israel launched the war on Gaza on October 7, 2023, after the Palestinian resistance movement Hamas carried out Operation Al-Aqsa Flood against the Israeli regime in response to its decades-long campaign of oppression against Palestinians.

The regime’s bloody onslaught on Gaza has so far killed at least 45,658 Palestinians, mostly women and children, and injured 108,583 others. Thousands more are also missing and presumed dead under rubble.
