Karnataka’s Religion Bill proposes 10-year jail for facilitating conversion of woman, minor and SC/ST

Bengaluru, Dec 16: Karnataka government’s proposed anti-conversion bill suggested up to 10 years of imprisonment and placed the “burden of proof” on the person who facilitated the conversion on the basis of force or coercion. 

The draft of the so called ‘Karnataka Protection of Right to Freedom of Religion Bill-2021’, which official sources say is not yet finalised, aims to prohibit "conversion from one religion to another religion by misrepresentation, force, fraud, undue influence, coercion, allurement or marriage".

Offences registered under the proposed bill will be cognizable and non-bailable. Imprisonment "shall not be less than three years, but which may extend to five years" along with a fine of around Rs 25,000. However, for conversion involving a minor, woman or a person belonging to Scheduled Castes or Scheduled Tribes, jail term can go up to 10 years with a fine of Rs 50,000.

The accused person will have to prove that the religious conversion was voluntary and not by force. Further, the bill makes a provision for the accused to pay up to Rs 5 lakh as compensation to those who were made to convert. 

The bill requires people willing to convert to declare at least 60 days in advance to the deputy commissioner and within 30 days of the conversion under a specified format. 

After the conversion, the “authority concerned shall take steps in accordance with applicable laws with regard to entitlement of persons converted to enjoy social status or to receive economic benefits from the government (prior to conversion),” the bill says. 

This means that a Dalit who converts should forego benefits he or she is entitled to as a member of the SC community. 

Any institution or organisation violating the provisions of the proposed law will not be eligible for any financial aid or grant from the government, the bill says. 

The bill noted that by virtue of Right to Freedom of Religion all persons are free to profess, practice or propagate any religion of their choice. However, "...Supreme Court has held that 'Right to Propagate' under Article 25 does not include the right to convert another person,” the bill notes.

“In recent years the state has noticed many (instances) of conversion by means of 'allurement', 'coercion', 'force', 'fraudulent means' and also 'mass conversion'. These instances caused disturbances of 'public order' in the state,” the bill explains.

“The Law Commission of Karnataka, after studying the various laws on the subject and considering the situation in the state in its thirtieth report, has made the recommendation to the government to enact a suitable law on the subject," the proposed bill says.

A student, who was addicted to online gambling, has ended his life after he failed to repay the loan on Thursday. The deceased is identified as B.Sc final year nursing student Somnath Chidri (22) who was studying at Gulbarga Institute of Medical College. He is a resident of Donagapur village in Bhalki taluk of Bidar district.

He had reportedly lost more than Rs 80 lakh in online gaming and borrowed money for the interest ranging from 4 per cent to 10 per cent.

Frustrated by lenders' harassment, he hanged himself from a tree near the Veerashaiva Hostel in the city. Somnath had also called his father and demanded Rs Rs 30 thousand. But, ended his life though his father agreed to send money.

Kalaburagi City Police Commissioner Sharanappa S D said that the parents of the deceased had agreed to send the money demanded by him. But, he ended his life before money was reached to him. His parents have lodged a complaint that he has lost Rs 70-80 thousand in online gaming, he added.

US and British warplanes have carried out fresh airstrikes on the Yemeni capital Sana'a and other regions, intensifying attacks as Yemeni Armed Forces continue their anti-Israeli operations in support of the Palestinians in the Gaza Strip amid the regime’s genocide.

Yemen’s al-Masirah television network reported that US and British aircraft targeted the premises of the Yemeni Defense Ministry in the the Assafi'yah district of Sana’a early on Tuesday.

Local sources heard loud explosions echoing from the site of the strikes. 

The report, however, did not provide any details regarding potential casualties or damage.

For his part, the Yemeni information minister vehemently denounced the latest US and British airstrikes against Sana’a, stating that the act of aggression “falls within the framework of attempts to diminish the Yemeni nation’s will to support Palestinian people.”

Hashem Sharaf al-Din underscored that enemies are unable to undermine Yemen’s military capabilities, as its government and nation are standing firm in the face of their vicious and terrorist attacks.

This came hours after the spokesman for the Yemeni Armed Forces announced in a statement that the country’s missile units had carried out a military operation against an Israeli military target in Tel Aviv, using a hypersonic Palestine 2 ballistic missile

Brigadier General Yahya Saree noted that the missile strike was in support of the Palestinians in the Gaza Strip, and successfully achieved its desired objectives.

The Yemeni Armed Forces will continue their operations, and will strike all Israeli facilities within the occupied territories, Saree pointed out, adding that such strikes will not stop unless the ongoing aggression on Gaza ends and the siege is completely lifted.

Early on Monday, American and British warplanes conducted a joint airstrike on targets at the Midi district in Yemen’s northern province of Hajjah.

US and British military aircraft also targeted a number of locations in the At Tuhayta district of the strategic western province of Hudaydah. Details on potential human or material losses from the strikes were not quickly disclosed.

Yemenis have declared their open support for Palestine’s struggle against the Israeli occupation since the regime launched a devastating war on Gaza on October 7, 2023, after the territory’s resistance movements carried out Operation Al-Aqsa Flood against the occupying entity.

The Yemeni armed forces have said they will not stop their attacks as long as Israel continues its ground and aerial offensives in Gaza.

So far, Israel has killed at least 45,028 Palestinians, mostly women and children, and injured 106,962 others in Gaza.

In October, the US military unleashed B-2 stealth bombers to bomb Yemen in support of Israel. Since then, attacks against Yemen have continued in a bid to halt the retaliatory attacks by Sana'a.

With the surging demand for air travel between the UAE and India, limited flight capacities are driving up ticket prices. Abdulnasser Alshaali, UAE's ambassador to India, has stressed the urgent need for increasing flight operations to curb rising airfares and bolster connectivity.

Addressing the inaugural UAE-India Founders' Retreat at Dubai International Financial Centre (DIFC) on Friday, Alshaali highlighted that the imbalance between demand and available seats is unsustainable. “Airfare has grown significantly due to heightened demand. Without more flights and seat capacities, prices will keep rising,” he cautioned.

Connecting More Cities
Alshaali revealed his proposal to add more flights between the two nations, emphasizing connections to Tier 2 cities in India. “Indians prefer flying to airports closer to their hometowns, especially on specific days. Expanding flight options is vital for meeting this demand,” he explained.

The ambassador stressed that increased connectivity would yield mutual benefits, including boosting tourism, creating jobs, and fostering business opportunities. “This is about redefining our relations to ensure a win-win outcome for both nations,” he remarked.

Strengthening Ties Through Innovation
The UAE-India Founders' Retreat, co-organized by the UAE Embassy in Delhi and the UAE-India CEPA Council (UICC), hosted over 60 Indian startup founders alongside UAE business leaders, investors, and policymakers. The three-day event aimed to deepen collaboration and promote innovation between the two nations.

Prominent attendees included Essa Kazim, Governor of DIFC, Hadi Badri, CEO of Economic Development at the Dubai Department of Economy and Tourism, and Faraz Khalid, CEO of Noon.

CEPA: A Testament to Success
Alshaali lauded the Comprehensive Economic Partnership Agreement (CEPA), which has significantly boosted trade relations. “Bilateral trade between India and the UAE has exceeded $80 billion, marking over a 15% growth since CEPA. Key sectors like pharmaceuticals and agriculture, including fruits and vegetables, have seen over 30% growth,” he noted.

Enhanced air connectivity, Alshaali emphasized, is not just about convenience. “It deepens people-to-people ties and facilitates easier travel for investors, students, and businesspersons, further solidifying our partnership,” he concluded.

The call for increased flights and better transportation links is poised to redefine the dynamics of UAE-India relations, catering to the evolving needs of both nations.
