Attempts to evict Malekudiyas is violation of Forest Tribal Rights Act: Karat

Mangalore, May 20: Attempts to forcefully evict Malekudiyas from their forest lands citing that it belongs to Kudremukh National Park is a violation of the Forest Tribal Rights Act, said Prakash Karat, General Secretary, CPI (M).

Speaking at a discussion meet on 'The menace of Naxalism and Atrocities against Adivasis and their Human Rights' organized by 'Maanavata Vedike' in Mangalore on Sunday, Mr. Karat said that as per the Act passed in 2007, the law recognizes the land of the tribal people inside the forest. “If there is any proof that they had been living there and carrying on cultivation, then their land is recognized even inside the forest. They can own up to five hectares of land inside the forest”, Mr. Karat revealed.

There has to be an expert committee which has to conduct a survey and check the land ownership of the tribals. It is only after the recommendation and clearance of this committee can the lands be cleared and handed over to others. The Act demands that adivasis be consulted before their land is being acquired and only with their consent and a suitable compensation package besides relocation, can their lands be acquired, Mr. Karat added.

The senior Communist leader observed that Mr. Vittala and other members of his tribe had been resisting the move of the authorities to acquire their lands for a compensation of Rs. 10 lakhs. “We do not accept this interpretation of the government that by declaring a land as a national park one can drive away tribals who have been living there from centuries”, he said.

Stating that tribals across the country are being ill-treated in a similar manner, Mr. Karat said that rules are being violated in tribal dominated areas in certain states where the 5th schedule of the constitution applies. “In areas that come under the specifications of the 5th schedule of the constitution, there are provisions for the protection of land rights of tribal people. No one can aquire their lands just like that as per the schedule. It demands that permission be sought from the local panchayat. Not even the state government can interfere. The Supreme Court too had said in a judgement a few years ago that no land can be bought from the tribal people without their consent. But today, this law is also being violated”, Mr. Karat lamented.

Expressing his concerns over the government's attempts to make amendments in the Mines and Minerals Act, Mr. Karat said that the government is trying to give license to mining companies and others to carry out their operations even in the areas that come under the 5th schedule. “We have been raising objections to this amendment in the Parliament”, Mr. Karat said.

Pointing out that tribal people have been actually conserving forests, Mr. Karat said that it is wrong on the part of authorities to drive them away from their lands. “The government says it needs to protect forests and destruction of forests is taking place. But who is responsible for this destruction? It is not the tribal people. They have been living harmoniously with nature for centuries and have been conserving forests. The real destruction of forests is carried out by other vested interests. There is a nexus between bureaucrats,contractors, and smuggling mafia in cutting down forests and this happens right under the nose of the government”, he said.

Draconian laws being used against adivasis

Recalling that POTA was used by the government to torture hundreds of Muslims in the name of tackling terrorism, Mr. Karat said that the adivasis are also being targeted by the authorities now by using Unlawful Activities Prevention Act.

“The honour killings being made on caste lines and atrocities against Dalits are not covered under Unlawful Activities Act but innocent adivasis are tortured using this Act. They are denied bail for six months and if the court is not satisfied about the proof of their innocence it even extends the bail denial period”, he said.

On Mr. Vittala and his father Mr. Linganna Malekudiya being charged with sedition and waging war against state, Mr. Karat said that that it was unfortunate that Bhagat Singh was charged with sedition and hanged during the British regime and the same charge of sedition has been charged against Mr. Vittala for possessing a book on Bhagat Singh. “The colonial tradition has continued”, he said.

Defence Committee

The district unit of the Vittala Malekudiya Defence Committee was formed on the occasion. Yashwant Maroli, President of Manavata Vedike, has been named the President of the Committee. Writer Sara Aboobakkar has been named the Vice President of the Committee. Muneer Katipalla, DYFI leader, has been chosen General Secretary. Ramachandra Babbukatte, Vasudev Uchil and advocate BM Bhat have been named secretaries.

Prakash Karat advised the Committee to mobilse public opinion in favour of Mr. Vittala Malekudiya.

Bengaluru: Karnataka Chief Minister Siddaramaiah on Thursday alleged that BJP was raking up the "Waqf issue" with an eye on the upcoming assembly by-polls in the state and elections in neighboring Maharashtra.

Following allegations by a section of farmers in certain parts of the state that their lands were marked as Waqf properties, he reiterated that none of them will be evicted, and notices issued to them will be withdrawn.

"BJP is doing politics. Notices were issued during their (BJP) tenure too, what do they have to say about it? During BJP's tenure over 200 notices were given. One should not practice such dual politics," Siddaramaiah said.

Speaking to reporters here, the CM said, "I have already said that the notices will be withdrawn, where is the issue? In case the notices are issued they will be withdrawn and no one will be evicted, where is the issue?" "Whichever district it is...They (BJP) had also given notices in several districts. Why did they give? Why are they doing such politics? In case notices were served by our government, they will be withdrawn and no farmers will not be evicted....the protest they have planned on November 4 is for politics keeping in mind by-polls in three segments and Maharashtra elections," he added.

A section of farmers from Vijayapura district have alleged that their lands were marked as Waqf properties, and similar allegations have surfaced from a few other places.

The BJP is planning a statewide agitation on November 4, demanding the resignation of Minority Welfare and Waqf Minister B Z Zameer Ahamed Khan, and against the Congress government over the issue.

Accusing the BJP of only doing politics and and not speaking the truth, Siddaramaiah said, "they only speak lies, they make issue out of non issue. Is there any issue in MUDA (site allotment case, in which he is accused and facing probe)? They wanted to make a non issue, an issue." Channapatna, Shiggaon and Sandur Assembly segments will go for by-polls on November 13.

The CM said he will go for campaigning in three assembly segments that will go for bypolls, from November 4 to 11.

He expressed confidence about Congress winning all the three segments.

Mangaluru: Deputy Chief Minister D K Shivakumar emphasized the urgent need for local job creation and a dedicated tourism policy to address communal tensions and rejuvenate the Dakshina Kannada region. 

He spoke during "Ashoka Jan-Mana," a clothing distribution event organized by Rai Estates Educational and Charitable Trust, under the leadership of MLA Ashok Rai, at Kombettu’s taluk stadium in Puttur on Saturday.

“There are challenges to communal harmony across the coastal and interior regions of Dakshina Kannada. To counter these issues, we must provide opportunities for our youth," Shivakumar stated. "The government is considering a specialized tourism policy for the coastal areas to attract more visitors and retain local talent."

Shivakumar expressed concern about a rising trend among local youth to migrate to Saudi Arabia, Mumbai, and Bengaluru due to limited job opportunities in the area. "Communal disturbances have also discouraged students from other districts from enrolling in our institutions, and several banks that originated here have closed down," he said.

Highlighting the region's potential, Shivakumar remarked, “Dakshina Kannada is home to many temples and boasts a rich coastline. Yet, despite Mangaluru having a major port, we still lack five-star hotels. Developing tourism here will be essential for creating jobs and fostering harmony.”

He also hinted at development projects proposed by Ashok Rai for Puttur, which are currently under wraps due to by-election restrictions. Assuring commitment, Shivakumar said, “Although we secured only two seats in Dakshina Kannada, we are committed to developing all constituencies in the region.”

The Deputy Chief Minister concluded with a powerful message on leadership, likening Ashok Rai to a modern embodiment of ancient virtues. “For success, one should have Dharmaraya's righteousness, Karna's generosity, Arjuna's focus, Vidura's ethics, Bhima's strength, and Krishna's strategy. Ashok Rai has all these qualities," he said, praising Rai’s dedication to the people of Dakshina Kannada.

Mangaluru: A heart-wrenching tragedy unfolded in the quiet Bellayuru village on the outskirts of Mangaluru as a man’s life ended on a railway track following an apparent double murder. Authorities from the Mulki police station identified the man as Karthik Bhat, 32, whose lifeless body was discovered on the tracks with his head positioned on the rail, indicating a tragic suicide.

Nearby, police recovered keys to a scooter and a house, which eventually led them to uncover a series of chilling events. Following the trail, officers located Bhat’s scooter parked near Mahammayi Temple. Inside the vehicle, they found documents confirming his identity, including an RC, insurance papers, and his driving license.

Their search continued to Bhat's home in Pakshikere, Kemral village, where they discovered a locked room. With the keys retrieved from the tracks, police unlocked the door, only to be confronted by a horrifying sight. The bodies of Priyanka (28) and her young son Hriday (4) lay in a pool of blood, pointing to a brutal murder that occurred just hours before Bhat’s suicide.

Initial investigations suggest Bhat, beleaguered by ongoing family disputes, committed the murders of his wife and son on the evening of November 8 before tragically ending his own life. A death note found in his diary hinted at his mental state and tragic intentions.

Priyanka’s family, residing in Shivamogga, was informed of the incident. The couple, married for six years, now leaves behind grieving relatives and unanswered questions. Police have initiated formal proceedings, collecting statements from family members as they continue their investigation into the tragic sequence of events.
