The district court which held K Ashok, 23, a worker with a Railways contractor, and A Nishit, 20, a Railways employee, guilty of raping a 15-year-old girl from Orissa on July14, 2010 acquitted Abdul Sattar Ayub, a vendor at the railway station, for lack of evidence.
The main accused Shameesh, a porter and sweeper from Payyanur, Kerala has been absconding since the incident.
The police arrested and booked cases against four in connection with the case.
It may be recalled that the minor girl was raped inside a train coach on the third platform of Mangalore Central Railway Station.
The girl, who escaped from a house in Kadri, where she was working as a domestic help, wanted to go back to her home in Orissa. She was taken away to the empty coach of a shunted train by the main accused and later was raped.
A sweeper, who found the girl in semi-nude and unconscious condition, informed the railway officials and later case was registered through Childline, Child Welfare Committee and the city police.
Judge Naik observed that the investigation report, evidence, forensic report, other medical reports and other dossiers were sufficient to hold the accused guilty.
Public prosecutor Manjunath V Bhat Panne argued in the case on behalf of the government.
