SC quashes FIR against Priya Varrier over 'wink'

New Delhi, Aug 31: The Supreme Court on Friday quashed an FIR against actor Priya Prakash Varrier, director and the producer of Malayalam movie 'Oru Adaar Love', which alleged that the 'wink song' video had hurt the religious sentiments of the Muslim community.

A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud said the Malayalam folk song, on which the song has been picturised with Varrier, has been in the public domain since 1978 and the song video cannot be termed as blasphemous.

"We allow the writ petition of Varrier and others and quash the FIR lodged against them in Telangana and further direct no FIR or any complaint under Section 200 of CrPC will be entertained against the petitioners for picturization of the song in question," the bench said.

Referring to a constitution bench judgement and a verdict delivered in a similar case lodged against cricketer M S Dhoni, it said no offence under Section 295 A of the IPC is made out against the 18-year-old actor and others in the present case.

Section 295 A of IPC deals with deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs.

The apex court had on February 21 stayed criminal proceedings against Varrier in some states, filed on the grounds that a song from her film allegedly hurt the sentiments of the Muslim community.

Varrier, who shot to fame after her 'wink video' went viral on the internet, is a B.Com student from a college in Kerala's Thrissur district. She had sought protection from an FIR lodged on complaints alleging that the lyrics of the song 'Manikya Malaraya Poovi' from the movie was "offensive" and "violated the religious sentiment of a particular community".

The actress had moved the apex court seeking quashing of the FIR lodged against her in Telangana and sought the top court's direction to prohibit states from initiating any criminal proceedings against her.

She had said that the FIR was lodged against her on February 14 at Falaknama police station in Hyderabad on a complaint that alleged that the song hurt the religious sentiment of a community.

On the same day, a criminal complaint was also filed by the Secretary of Raza Academy, Mumbai, with the Commissioner of Police seeking action against the petitioners, taking down the video and preventing it from being broadcast, she had said.

She had said the entire controversy had resulted in the filing of several criminal complaints, while the FIR arose from the lyrics of the song, which is a Mappila song or a traditional number from the Malabar region of Kerala.

Her plea had said the claims that it hurt religious sentiments of Muslims were "without any basis and what is hard to fathom is that a song which has been in existence for the past 40 years, which was written, sung and cherished by the Muslim community in Kerala is now being treated as an insult to the Prophet and his wife."

"It is submitted that a song, which .... has been cherished by more than one crore Muslim population of Kerala, cannot suddenly offend the religious sentiments of the Muslim community," it had said.

The plea had stated that criminal complaints and registration of FIRs in multiple states were filed on the basis of complaints by "fringe elements who have misunderstood the lyrics of the song which they claim allegedly offended their religious sentiments and that of their community has adversely affected the petitioners right to life, liberty and freedom of expression under the Constitution."

The plea had said the movie was then yet to be completed and about Rs. 1.5 crore have been spent on it, but such "flimsy and baseless" complaints and FIRs caused "nothing but a hindrance to freedom of speech and expression granted under Article 19(1)(a) of the Constitution" and "an outright abuse" of the legal process.

Udupi: Six junior artists from the prequel of Kannada blockbuster film ‘Kantara’ were injured, when the bus they were travelling in overturned in the district, police said on Monday.

According to police, the accident occurred near Jadkal on Sunday night when the mini-bus carrying the crew of the film overturned.

“The incident happened while they were returning to Kollur after completing the shoot at Mudoor in Jadkal. The mini-bus was carrying 20 junior artistes when it met with the accident,” a police officer said.

The injured were rushed to hospitals in Jadkal and Kundapur for treatment, they said.

The Kollur police are investigating the matter.

"The news making rounds is completely false. The Kantara: Chapter 1 team began shooting at 06:00 AM today, and everything is proceeding as normal. A minor accident occurred 20 kilometres away from the shooting location, involving a local bus carrying some members of the Kantara team. However, no injuries were reported," a source close to the production said.

Udupi: A 53-year-old woman fell victim to a sophisticated online fraud, losing ₹19.7 lakh to scammers posing as officials from telecom companies and the police.

According to the complaint filed by Vidya, the incident began on October 4 when she received a call from an individual claiming to be from Airtel. The caller alleged that a SIM card linked to her Aadhaar was being misused in Mumbai for spam and fraudulent activities. They warned her that all her mobile numbers could be blocked and connected her to a supposed "Sahara police station."

A man identifying himself as Mohan Kumar, an "investigation officer" from the Sahara police station, then contacted Vidya. He alleged that a fraudulent bank account had been opened in her name at an SBI branch in Mumbai. This account, he claimed, was being used for human trafficking and money laundering activities by someone named Vivek Das. He insisted that all her bank accounts needed to be reviewed.

On October 5, the scam escalated when Kumar, posing as a police officer, threatened Vidya with arrest and warned her not to leave her location without his permission. He demanded that she transfer funds from her accounts to specific UPI IDs and bank accounts under the pretext of "reviewing" her finances. Fearing legal consequences, Vidya complied and transferred ₹19.7 lakh in installments between October 16 and November 7.

The fraud came to light only after she realized she had been deceived. A case has been registered at the CEN (Cyber, Economic, and Narcotics) police station, and an investigation is underway.

Hamas says the Israeli regime’s sole objective lies in “erasing” the entirety of the Palestinian population from across the Palestinian territories.

Khalil al-Hayya, a ranking official with the Gaza Strip-based Palestinian resistance movement, made the remarks to the Palestinian al-Aqsa TV on Wednesday.

“The occupation targets everyone—it strikes hospitals, civil defense, women, children, and the elderly,” he said, adding that the regime sought to “empty Gaza of its residents, and displace the Palestinian people to fulfill its dreams of building a Zionist Jewish state across all of Palestine.”

The remarks came amid the regime’s October 2023-present war of genocide on the coastal sliver that has so far claimed the lives of nearly 44,000 Palestinians, mostly women and children.

“This unprecedented aggression in modern times evokes scenes from the dark ages of human history, having crossed all red lines and exceeded every expectation of brutality in the modern era,” the Palestinian official lamented.

He also regretted that the regime had added “systematic and dangerous starvation to its aggression, falsely claiming before the world that it allows 250 [aid] trucks into Gaza daily. In reality, the number of trucks is far fewer.”

Hayya, meanwhile, regretted that “scenes of children torn apart, women screaming over their children, and heart-wrenching destruction have failed to stir enough humanity to stop these crimes.”

He decried the United States for vetoing the United Nations Security Council’s resolutions that are aimed at bringing about a potential ceasefire in the war, saying this indicated Washington’s “partnership in the aggression” and a simultaneous siege that the Israeli regime has been enforcing on Gaza.

Addressing Israeli Prime Minister Benjamin Netanyahu, the official asserted that, despite what the Israeli official is after, Hamas would not hand over the regime’s captives “without [the regime’s] stopping the war.”

He called Netanyahu “the main obstacle” in the way of cessation of the aggression, saying the Israeli premier “blocks any progress for political reasons,” and citing his preventing conclusion of a ceasefire agreement in July.

Hayya also warned that the regime sought to expand the war beyond Gaza, but asserted that its goals are “impossible and will never happen.”

“Today, the enemy exposes its true intentions of extermination and displacement, but it will fail,” he stressed.

“The Palestinian people are resilient and will not surrender, as they believe in their humanitarian and political cause. The enemy and its allies will not succeed in achieving their goals. This steadfast people will endure, and the occupation will not prevail against them.”
