Supreme Court to hear Centre's plea after violent Dalit protests

New Delhi, Apr 3: The Supreme Court on Tuesday said that it will hear the Centre's plea for the recall of its judgement holding that arrest on a complaint under the SC/ST (Prevention of Atrocities) Act was not mandatory.

Directing the listing of the matter at 2pm, before a bench of Justice Adarsh Kumar Goel and Justice Uday Umesh Lalit, Chief Justice Dipak Misra said the hearing will be in open court.

Lok Sabha adjourned till noon

The Lok Sabha was disrupted once again today amid protests, with Speaker Sumitra Mahajan adjourning the House till noon within minutes of meeting.

As soon as the House met, AIADMK members started protesting near the Speaker's podium, demanding the setting up of the Cauvery Management Board.

Members of opposition parties were seen standing on their seats.

Speaker Mahajan tried to run the Question Hour, but as protests continued, she adjourned the House.

9 dead, thousands arrested as protests turn violent

Nine persons were killed and dozens injured as Dalit protests during a day-long nation-wide shutdown on Monday turned violent in India amid anger against a Supreme Court order that dilutes a law aimed at preventing atrocities against Dalits and Tribes.

The government, in a bid to pacify the agitated activists, said it had filed a petition in the apex court seeking a review of its March 20 order that bars automatic arrest and registration of cases for alleged harassment of Dalits and others. But the top court denied an urgent hearing of the matter.

Protesters clashed with police in Gujarat, Madhya Pradesh, Rajasthan, Punjab, Uttar Pradesh, Uttarakhand, Jharkhand, Bihar and Odisha -- states where normal life was paralysed in varying degrees amid incidences of violence and arson.

The central government rushed 800 anti-riot policemen to violence-hit Uttar Pradesh and Madhya Pradesh.

A Home Ministry official in Delhi said two companies of Rapid Action Force (RAF) were sent to Meerut and one company each to Agra and Hapur in Uttar Pradesh.

Clashes turned deadly in Madhya Pradesh where six persons were killed and dozens injured, forcing officials to impose curfew in Morena, Gwalior and Bhind districts. Protests were also held Bhopal as agitators blocked roads in the state capital.

Madhya Pradesh Chief Minister Shivraj Singh Chouhan made a passionate appeal for peace.

 Police said two were killed in Bhind and one in Morena while three died in Gwalior. The dead in Morena was identified as Rahul Pathak, a student leader.

Gwalior District Magistrate Rahul Jain said that at least 65 persons have been injured in violence, including policemen, and the condition of a few injured is said to be serious.

"Three people have been conformed dead in Gwalior," he said.

A man identified as Pawan Kumar was killed in Rajasthan's Alwar as violence was also reported from other parts of the state including Jaipur, Ajmer. Jaisalmer, Barmer, Jodhpur and Udaipur.

Punjab and Haryana also saw widespread protests.

Shops, educational institutions and other establishments remained closed and Class 10 and 12 examinations were deferred in Punjab, which has the highest concentration of Scheduled Castes, constituting nearly 32 per cent its 2.8 crore population.

Hundreds of protesters carrying swords, sticks, baseball bats and flags forced shopkeepers and other establishments in Jalandhar, Amritsar and Bathinda too shut down.

Protests also took place in Rohtak and other towns of neighbouring Haryana.

In Bihar, activists disrupted rail and road traffic. Mobs shut down markets and shops as well as educational institutions, police said.

Supporters of the Bhim Army and other Dalit outfits halted over three dozen long-distance and local trains, stranding thousands of passengers.

Violence was reported from Vaishali, Muzaffarpur, Nawada, Patna and Bhagalpur when protestors clashed with police.

One person was killed and over 100 were injured as violence also erupted in parts of Uttar Pradesh as protesters attacked shops, looted some and pelted stones at police in Hapur, Agra, Meerut, Saharanpur and Prime Minister Narendra Modi's Lok Sabha constituency Varanasi.

Maximum violence in the state was reported from western Uttar Pradesh, where the protesters took to the streets and went on rampage. Two persons were critically injured in police firing in Muzaffaranagar, one of whom later succumbed.

More than 450 people, including a former Bahujan Samaj Party (BSP) legislator, have been arrested.

Many cars were targeted and their window panes smashed. At some places, government property was targeted.

Some people reportedly fired at a police team in Meerut while a passenger bus was set on fire.

Also in Meerut, over 500 Dalit youths targeted the media and broke their cameras as they were trying to photograph the protests.

 Gujarat's major towns and cities also saw protests by Dalits amid reports of vandalism from Ahmedabad and Jamnagar.

Amid widespread anger and violence, the Modi government filed a review petition in the Supreme Court to seek recall of its judgment that ruled that there would be no automatic arrest of an accused following a complaint moved under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The Supreme Court had held on March 20 that police will hold an inquiry to ascertain the veracity of the complaint filed under the act before acting on it.

Union Law Minister Ravi Shankar Prasad said the government "with due respect, does not agree with the reasoning given by the apex court".

Mangaluru: District-in-Charge Minister and Minister for Health and Family Welfare, Dinesh Gundu Rao, announced that a day-care chemotherapy centre will soon be established at District Wenlock Hospital. Speaking to mediapersons after reviewing the activities at Wenlock and Government Lady Goschen Hospital, he shared the government’s plans to enhance healthcare services in the region.

Key Initiatives Announced

•    Day-Care Chemotherapy Centre:

  • Ten beds will be reserved for cancer patients.
  • The government will collaborate with Yenepoya Hospital to provide chemotherapy treatments.
  • All required facilities for the centre are already in place, awaiting inauguration by the Chief Minister.

•    Wenlock Hospital Facelift:

  • Critical Care Block: To be built at a cost of ₹24 crore.
  • Integrated Public Health (IPH) Lab: Planned with a budget of ₹1 crore.
  • New OPD Block: As per a 2017 agreement, KMC Hospital will take up construction. Discussions with KMC management are underway.

•    Additional Requirements:

  • A new mortuary and post-mortem building.
  • Paramedical college building.
  • Modern kitchen.
  • Bridge connecting two buildings within the hospital.

•    Total facelift cost: ₹6 crore to ₹10 crore, utilizing funds from the Department of Health and Family Welfare and CSR contributions.

•    Timeline:
By December or January, priority works will be finalized. The superintendents of Wenlock and Lady Goschen Hospitals are scheduled to visit Bengaluru next week to discuss these projects.

•    MRI Fee Allegations:
The minister assured that allegations of patients being charged for MRI scans at Wenlock Hospital will be resolved at the earliest.
These measures aim to improve healthcare accessibility and infrastructure, positioning Wenlock Hospital as a state-of-the-art facility in the region.

Bengaluru: The Prime Minister Narendra Modi led union government has requested the Karnataka High Court to direct the Mandya district administration and the state government to clear a madrasa operating within the premises of the historic Jama Masjid in Srirangapatna.

The Waqf Board, opposing this move, has claimed the mosque as its property and defended the right to conduct madrasa activities there.

The matter was brought before a division bench headed by Chief Justice N V Anjaria following a public interest litigation filed by a person named Abhishek Gowda from Kabbalu village in Kanakapura taluk. The petition alleged “unauthorised madrasa activities” within the mosque.

Representing the Central government, Additional Solicitor General of India for High Court of Karnataka, K Arvind Kamath argued that the Jama Masjid was designated as a protected monument in 1951, yet unauthorised madrasa operations continue there.

He noted that concerns over potential law and order issues have so far prevented any intervention. Kamath urged the court to direct the Mandya district administration to take action and vacate the madrasa from the mosque.

In defence, lawyers for the state government and the Waqf Board contested this request, stating that the Waqf Board had been recognised as the owner of the property since 1963 and, thus, conducting madrasa activities there is lawful.

After hearing both sides, the bench adjourned the case for further arguments, scheduling the next hearing for November 20.

Bengaluru: In a boost to the ruling Congress in Karnataka, the party on Saturday swept the by-polls to three Assembly segments, causing a major setback to the BJP-JD(S) alliance in the state.

The Congress has retained Sandur, the seat considered to be its strong hold, and has also bagged Shiggaon and Channapatna segments, which were earlier held by BJP and JD(S) respectively.

The November 13 by-polls to Sandur, Shiggaon and Channapatna Assembly segments had witnessed a fierce fight between the ruling Congress and a combative BJP-JD(S) alliance.

The by-polls to Sandur, Shiggaon and Channapatna were necessitated as the seats fell vacant following the election of their respective representatives -- E Tukaram of Congress, former CM Basavaraj Bommai of BJP, and Union Minister Kumaraswamy of JD(S) to Lok Sabha in May elections.

The by-polls witnessed a straight fight between the ruling Congress and BJP in Sandur and Shiggaon segments, while in Channapatna, JD(S) which is part of the NDA alliance took on the grand old party.

Congress' C P Yogeeshwara won the Channapatna segment, defeating JD(S) candidate and Kumaraswamy's son Nikhil Kumaraswamy, by a margin of 25,413 votes.

Former CM Basavaraj Bommai's son Bharath Bommai of BJP faced defeat against Congress' Yasir Ahmed Khan Pathan in Shiggaon Assembly segment by a margin of 13,448 votes.

In Sandur, Congress candidate E Annapoorna, the wife of Bellary MP E Tukaram, won the seat vacated by her husband, by a margin of 9,649 votes.

Congress' win in the by-poll is seen as an endorsement of both Chief Minister Siddaramaiah and his deputy D K Shivakumar's leadership, and the government's programmes, especially the five guarantee schemes.

Nikhil Kumaraswamy and Bharath Bommai, the third generation of Gowda and Bommai family respectively, who contested this bypolls, have lost. Their fathers and grandfathers had served as Karnataka's Chief Ministers in the past.

While for Bharath Bommai this was his electoral debut, for Nikhil it was his third electoral loss.

Among the three segments, Channapatna was considered to be a high profile battle, where the contest was between C P Yogeeshwara and actor-turned-politician Nikhil Kumaraswamy.

A five-time MLA from the segment and a former Minister, Yogeeshwara had joined the Congress after quitting BJP ahead of nomination.

There were plans to field Yogeeshwara on a JD(S) ticket, but he was not interested in it, and instead wanted Kumaraswamy to support him as BJP candidate. This was not acceptable to Kumaraswamy and his party, following which Yogeeshwara jumped ship.

However, Kumaraswamy had subsequently said he had agreed to Yogeeshwara contesting from BJP, and despite that he jumped ship to Congress, under the influence of Deputy Chief Minister D K Shivakumar and his brother and former MP D K Suresh.

Nikhil had faced defeat in 2019 Lok Sabha and 2023 Assembly polls. It is seen as a setback for Kumaraswamy too, as he could not ensure son's win from the Channapatna, the seat he had twice represented in the past.

Congress' win is crucial for Shivakumar, who is also the state Congress chief and his brother Suresh to strengthen their position in their home district of Ramanagara, a Vokkaliga heartland.

In Shiggaon, BJP's Bharath Bommai, son of Basavaraj Bommai lost against Congress' Yasir Ahmed Khan Pathan, who had faced defeat against the former Chief Minister in the 2023 Assembly polls.

Initially, former MLA Syed Azeempeer Khadri, a Congress' ticket aspirant, had raised a banner of revolt in Shiggaon, by filing his nomination as an independent, but later withdrew after intervention by party leadership.

In Sandur, Bellary MP Tukaram's wife E Annapurna of Congress won from the seat vacated by her husband, against BJP ST Morcha president Bangaru Hanumanthu, who is considered close to party leader and former mining barron G Janardhan Reddy.

Sandur is a Congress' bastion, and Tukaram had represented it four times.

Congress winning the by-polls is seen as "crucial" for Chief Minister Siddaramaiah to assert himself , amid demands for his resignation following charges against him in the MUDA site allotment case.

There were also behind-the-scenes political activities within the ruling Congress earlier this year, with a few ministers in his Cabinet holding closed door meetings, fueling speculation about leadership change. But such activities came to a halt following instructions from the party high command.

It is equally important for Shivakumar, who has not shied away from openly expressing his Chief Ministerial ambitions, amid speculations over "rotational Chief Minister formula," according to which he will become CM after two-and-half years (in this govt's five years tenure), but they have not been officially confirmed by the party.

The defeat in this by-poll is seen as a setback for state BJP President Vijayendra, who has been facing intense criticism and opposition from a section within the party, who have raised a banner of revolt against his leadership accusing him and his father, veteran leader B S Yediyurappa of "adjustment politics".
