Choosing My Religion: ‘Freedom of Religion Laws’ to Curb Liberty

Indian Constitution gives us the right to practice, preach and propagate our religion. To not to follow any religion is also a matter of right for the individual. Now in our country as we are facing declining GDP, worsening economic situation, rising prices-unemployment-farmers suicides and currently farmer’s agitation, some of our state Governments are more worried about the interfaith marriages and conversions. Some of them are busy putting forth the laws to prevent conversions. As such conversions have been nagging issue since last few decades but currently they are being attributed as the goal behind inter faith marriages. BJP ruled states and particularly UP, are busy formulating the laws to punish those who are involved in the process of conversions. Parallel to the efforts of state Governments, the vigilante groups are having a gala time harassing couples to ‘save their religion’!

Conversion, mainly away from Hinduism, is yet again coming to fore. The UP Government is planning an ordinance against organizations which are involved in conversion process. As per this organizations will lose their registration and face dire consequences. The ordinance demands a two-month notice to be given to the local administration. The local administration will have the power to decide whether your intended act is legal or not. And of course the burden of proof will be on the converts and the persons converting them. There is a special; mention of SC/ST and women. Many states are now vying to bring in anti ‘Love jihad’ and anti-conversion laws. There are many individual cases where couples and their relatives are being tormented by groups in the name of conversion and love jihad. Many of the laws being framed by the states are mostly against many provisions of Indian constitution.

During freedom movement, Arya Samaj had started Shuddhi movement to bring back those who had embraced other religions. Similarly Tablighi Jamat was active with the parallel campaign of Tanzim to convert people into Islam. The biggest conversion of twentieth Century was of course the one undertaken by Bhimrao Ambedkar. This conversion as such tells us the real cause of the conversions into other religions. Ambedkar, a dalit, got the highest of degrees and on return he had to face the ignominy of being and untouchable. In his struggles for social justice and for dignified life his, his major conclusions were that Hindus cannot be a nation due to the caste hierarchy. Hinduism is dominated by Brahmanical values. This is what made him declare that ‘I was born a Hindu that was not in my hands but I will not die a Hindu’.

His exploration led him to Buddhism, which formed that basis of his decision to embrace Buddhism along with over three lakh followers. Law Professor Sameena Dalwai, in her article draws our attention to the fact that had the present type of laws would have been there, Ambedkar might be behind the bars by now. The architect of Indian Constitution was for Liberty. Liberty does include right to our choice to follow any faith of our liking, or to be an agnostic or atheist as well.

While many people have not been exercising their right to choose their religion, many have done so in the past. That’s how Islam, Christianity, Sikhism and Buddhism spread in India. Buddhism did face a painful trajectory as it was attacked by elite intolerant traditions within Hinduism, which are totally against the concept of equality as propounded by Buddhism. Birth based inequality is peculiar feature of some sects prevailing here, with the sanction of Holy Scriptures. As a practice it is also part of other religions to some extent.

While today so many obstacles are being erected for the odd one opting to change one’s religion, history has seen streams of conversions, minor and major, to Islam and Christianity. Indian history has seen conversions mainly due to two factors. One is the tyranny of caste oppression. Swami Vivekananda tells us, “and The Mohammedan conquest of India came as a salvation of the downtrodden, to the poor. That is why one fifth of our people have become Mohammedans. It was not the sword that did it all. It would be the height of madness to think that it was all the work of sword and fire. It was to gain their liberty from the… zaminders and from the Priest, and as a consequence you find in Bengal there are more Mohammedans than Hindus amongst cultivators, because there were so many zaminders there.” (Selected Works of Swami Vivekanand, Vol.3, 12th edition, 1979.p.294.Extracted from the sayings of Swami Vivekananda compiled in `Proletariat! Many a conversions did take place also due to the social interaction and spiritual quest also. Some victor Kings also put humiliating condition of acceptance of their religion by the defeated kings. In India it was mainly the interaction with Sufi saints that many took to Islam. One interesting example is that of Dileep Kumar becoming A. R. Rahman, under the influence of a Sufi saint.

The second phenomenon is that of Christian missionaries. They have been working on issues of health and education in remote areas also. A couple of decades ago Pastor Stains was done to death on pretext of conversion (1999) and in 2008 anti Christian violence has been orchestrated in places like Kandhamal in particular. The extent of this conversion is not very huge if we see that despite centuries of work, the Christian population in India as per the census of 2011 is 2.3%. (First Church was set up by St. Thomas in AD 52).

Political phenomena of ‘reconversion to Hinduism’ are not far behind as witnessed in Agra, where the pavement dwellers were promised the BPL card and ration card. They were lured to come to a puja and declared that now they are Hindus. Ghar Wapsi by giving bath in hot springs in Adivasi areas is very much there. This is a political move to bring these sections into the fold of caste hierarchy, yet again.

Mangaluru: The Kavoor police in Mangaluru, Karnataka, have arrested three individuals from Kerala in connection with two separate cybercrime cases, including one involving extortion under the guise of a "digital arrest."

City Commissioner of Police Anupam Agrawal reported that one of the arrested individuals, Nisar, a resident of Ernakulam district, posed as a CBI officer. He allegedly threatened the complainant with arrest and extorted Rs 68 lakh. A case has been filed under sections 66 (C) and 66 (D) of the IT Act, and sections 308 (2) and 381 (4) of BNS.

In another case, the Kavoor police arrested two men, Sahil K P of Thiruvannur, Kozhikode, and Muhammad Nashath of Mappila Koyilandy, Kerala, in connection with a share trade fraud. The accused are alleged to have deceived the complainant by promising substantial profits from an investment in the stock market. Trusting the fraudsters, the complainant invested Rs 90 lakh, which was subsequently lost. A case has been registered under sections 66 (C) and 66 (D) of the IT Act, and sections 318 (4) and 3 (5) of BNS.

The accused were arrested in Koyilandi and presented before the court. The operation was carried out under the guidance of City Police Commissioner Anupam Agrawal, led by Mangaluru North Sub-Division ACP Srikanth K, Kavoor Inspector Raghavendra Byndoor, Kavoor PSI Mallikarjuna Biradara, and staff members Ramanna Shetty, Bhuvaneshwari, Rajappa Kashibai, Praveen N, and Malatesh.

The UN humanitarian coordinator for Lebanon has warned that the “picture of life in Lebanon remains grim,” highlighting an "alarming" level of human suffering and significant humanitarian consequences due to the ongoing Israeli carnage.

Imran Riza, the UN Deputy Special Coordinator and Resident and Humanitarian Coordinator for Lebanon (UNSCOL), provided a stark overview of the Arab country's dire circumstances in a statement released on Monday.

“The current picture of life in Lebanon remains grim. Yesterday, airstrikes reportedly killed 23 people, including seven children, in the village of Aalmat in Mount Lebanon,” Riza said on X.

An airstrike in the city of Tyre on the same day resulted in the tragic deaths of five siblings from a single family, all of whom had special needs, according to his statement.

He added that in the last week, Israeli airstrikes have killed at least 241 individuals and left 642 others injured in Lebanon, as reported by the Ministry of Health.

“In the past month, more than 185,000 people have fled their homes in their search for safety within the country, bringing the total to over 870,000 people internally displaced,” Riza said

The UN official highlighted that numerous individuals, including the elderly and those with health issues, are staying behind while witnessing the ruins of their ancestral homes.

He urged for the swift safeguarding of civilian people and infrastructure, emphasizing the necessity to uphold international humanitarian law and end the ongoing violence.

Lebanon’s National News Agency reported that Israeli forces bombed a house in the town of Maydoun in Bekaa on Monday night, killing three people and destroying the house.

Earlier, Israel bombed the northern town of Ain Yaaqoub, killing at least 14 people.

The killings came as Israeli military continued to pound Lebanon, bombing shops selling electrical appliances in the southern city of Tyre and carrying out air raids on the towns of Shamshtar in eastern Baalbek and Roumine in southern Nabatieh.

Lebanon’s Ministry of Health said Israeli attacks killed at least 54 people across the country on Monday.

Israel’s merciless attacks continue despite calls from the UN Security Council for an immediate ceasefire and directives from the International Court of Justice urging measures to prevent genocide and alleviate the dire humanitarian situation in Gaza and Lebanon.

In Lebanon, at least 3,243 people have been killed and 14,134 others wounded in Israeli attacks since the war on Gaza began on October 7, 2023.

The Lebanese resistance movement Hezbollah opened a support front for Palestinians in Gaza only a day after the Israeli regime unleashed its genocidal war on the besieged territory.

Bengaluru: In a boost to the ruling Congress in Karnataka, the party on Saturday swept the by-polls to three Assembly segments, causing a major setback to the BJP-JD(S) alliance in the state.

The Congress has retained Sandur, the seat considered to be its strong hold, and has also bagged Shiggaon and Channapatna segments, which were earlier held by BJP and JD(S) respectively.

The November 13 by-polls to Sandur, Shiggaon and Channapatna Assembly segments had witnessed a fierce fight between the ruling Congress and a combative BJP-JD(S) alliance.

The by-polls to Sandur, Shiggaon and Channapatna were necessitated as the seats fell vacant following the election of their respective representatives -- E Tukaram of Congress, former CM Basavaraj Bommai of BJP, and Union Minister Kumaraswamy of JD(S) to Lok Sabha in May elections.

The by-polls witnessed a straight fight between the ruling Congress and BJP in Sandur and Shiggaon segments, while in Channapatna, JD(S) which is part of the NDA alliance took on the grand old party.

Congress' C P Yogeeshwara won the Channapatna segment, defeating JD(S) candidate and Kumaraswamy's son Nikhil Kumaraswamy, by a margin of 25,413 votes.

Former CM Basavaraj Bommai's son Bharath Bommai of BJP faced defeat against Congress' Yasir Ahmed Khan Pathan in Shiggaon Assembly segment by a margin of 13,448 votes.

In Sandur, Congress candidate E Annapoorna, the wife of Bellary MP E Tukaram, won the seat vacated by her husband, by a margin of 9,649 votes.

Congress' win in the by-poll is seen as an endorsement of both Chief Minister Siddaramaiah and his deputy D K Shivakumar's leadership, and the government's programmes, especially the five guarantee schemes.

Nikhil Kumaraswamy and Bharath Bommai, the third generation of Gowda and Bommai family respectively, who contested this bypolls, have lost. Their fathers and grandfathers had served as Karnataka's Chief Ministers in the past.

While for Bharath Bommai this was his electoral debut, for Nikhil it was his third electoral loss.

Among the three segments, Channapatna was considered to be a high profile battle, where the contest was between C P Yogeeshwara and actor-turned-politician Nikhil Kumaraswamy.

A five-time MLA from the segment and a former Minister, Yogeeshwara had joined the Congress after quitting BJP ahead of nomination.

There were plans to field Yogeeshwara on a JD(S) ticket, but he was not interested in it, and instead wanted Kumaraswamy to support him as BJP candidate. This was not acceptable to Kumaraswamy and his party, following which Yogeeshwara jumped ship.

However, Kumaraswamy had subsequently said he had agreed to Yogeeshwara contesting from BJP, and despite that he jumped ship to Congress, under the influence of Deputy Chief Minister D K Shivakumar and his brother and former MP D K Suresh.

Nikhil had faced defeat in 2019 Lok Sabha and 2023 Assembly polls. It is seen as a setback for Kumaraswamy too, as he could not ensure son's win from the Channapatna, the seat he had twice represented in the past.

Congress' win is crucial for Shivakumar, who is also the state Congress chief and his brother Suresh to strengthen their position in their home district of Ramanagara, a Vokkaliga heartland.

In Shiggaon, BJP's Bharath Bommai, son of Basavaraj Bommai lost against Congress' Yasir Ahmed Khan Pathan, who had faced defeat against the former Chief Minister in the 2023 Assembly polls.

Initially, former MLA Syed Azeempeer Khadri, a Congress' ticket aspirant, had raised a banner of revolt in Shiggaon, by filing his nomination as an independent, but later withdrew after intervention by party leadership.

In Sandur, Bellary MP Tukaram's wife E Annapurna of Congress won from the seat vacated by her husband, against BJP ST Morcha president Bangaru Hanumanthu, who is considered close to party leader and former mining barron G Janardhan Reddy.

Sandur is a Congress' bastion, and Tukaram had represented it four times.

Congress winning the by-polls is seen as "crucial" for Chief Minister Siddaramaiah to assert himself , amid demands for his resignation following charges against him in the MUDA site allotment case.

There were also behind-the-scenes political activities within the ruling Congress earlier this year, with a few ministers in his Cabinet holding closed door meetings, fueling speculation about leadership change. But such activities came to a halt following instructions from the party high command.

It is equally important for Shivakumar, who has not shied away from openly expressing his Chief Ministerial ambitions, amid speculations over "rotational Chief Minister formula," according to which he will become CM after two-and-half years (in this govt's five years tenure), but they have not been officially confirmed by the party.

The defeat in this by-poll is seen as a setback for state BJP President Vijayendra, who has been facing intense criticism and opposition from a section within the party, who have raised a banner of revolt against his leadership accusing him and his father, veteran leader B S Yediyurappa of "adjustment politics".
